This is what you can do - Both in Mumbai and in Delhi, you have USCIS approved doctors who help people going through CP. In other words those who choose to go through emp based CP or family based Green Card which US embassy issues, go through Indian hospitals in Mumbai and Delhi. I think Gangaram in Mumbai has this facility. Ask your wife to get it done from there. Do not wait till the last moment, as someone pointed out, a slight delay in flight could............
Are you sure about this ? My understanding is, they don't recognize those doctors here and I remember seeing such note some where in the consulate website.

Eb3I may nudge forward a little bit. Sadly that won't be very helpful to most folks on this board. Visa recapture is the only thing that can help near term. In the interim, administrative fixes, rule clarifications, USCIS efficiencies in application processings, Data transparency, though not glamorous victories as say visa recapture. Nonetheless make the path somewhat more comfortable and predictable.
EB3ROW may move also.
The movement of EB2I will be quite revealing for me. If there is quarterly spillover(which under current rules should be the case) then we might see some forward movement or at the very minimum the dates should stay put. However if there is no quarterly spillover, then with the approvals in EB2 recently, they will be hard pressed not to move dates backward somewhat.

If you can get employer verification letter stating that the position is still available for you and your salary, then file I485 yourself.

Here is my daughter's case:
1994 she was 8 years old when we brought her to USA

I mean, these kids like my daughter (and I am sure there are thousands like her), deserve a break too. If the DREAM ACT is going to benefit illegal persons, it should also benefit children that have waited for their parents' LC process for long years only to see their hopes destroyed.

My wife travelled to India via Munich (Lufthansa) in Feb end and she had no issues with transit visa. She was never asked about it. The I-94 had expired and we have a valid AP and approved H1 (unstamped). She has not returned yet, so any requirement on return journey is untested.
I was nervous before she left and was wondering if I need a transit visa for her. Thanks everyone who posted their experiences.

I know several ladies from my Bradley class who have delivered their babies there and have great reviews.
Their total fee is $4,950 for all the prenatal care and normal pregnancy and delivery (no insurance).
Also anyone who wants to avoid medicated deliveries should check out Bradley classes.

You wait for 120 days and make umpteen calls to USCIS. Finally you get your EAD which is valid only for 10 months eventhough your priority date is predicted to be in next Ice Age.
If you want to correct the mistake done by USCIS go through some more pain and hassles or suck it and shell your hard earned money to renew after 10 months.I guess no one in USCIS cares for shoddy service they do.

That actually might be a good idea. These companies that mess with employees and take advantage of their visa status, should be taught such a torrid lesson that any other freakin desi consultants will think twice b4 messing with their employees. We already have a 12 member offshore team...the average asking rate (H1s and citizens) is 90K ..H1B quota restriction is working in our favor very much. Now how does that makes me an anti-immigrant :mad: :mad: :mad: . I am ofcourse happy that so many of my friends here are going one step further in getting GC. Something is better than nothing. But, suddenly more than 1/2 mill people getting EAD will have some effect on the market. People(on H1B) loosing jobs after 3-4 months may find themselves in a difficult situation to get a job.
I am on H1B myself, how can I ever be an anti-immigrant ?:) :) I was expecting a little bit more permamnent solution and not a band-aid solution as somebody pointed out.

My Priority Date Sep 2002 EB3
According to LC, my labor got approved on Aug 9th, but we received actual paper on Sep 9th .. So lost the chance to FILE 485
DOL took more than a month TO send papers ..
There is no point in blaming IV . They are the BEST ..
It is US Govt agencies who are lazy and ineptitude.
US did not get Civil Rights in one year .. it took decades of fight ...
IV is fighting for every one ..

I have a similar question that has been bugging me for some time and hasn't gotten a clear answer. Here is the details and not sure if there would be any problem to I-485.
1. My wife came to US on H4 in Dec '03 which is valid up to sept' 06. Given I-94 reflecting same.
2. Traveled outside US on H4 twice and each time got new I-94 till Set' 06.
3. Applied for H1B and got approved for adjustment for status from Oct' 2005 with I-94 at the bottom of approval notice. H1B approval notice and I94 is valid till sept' 2008.
4. Employer (consulting firm) insisted on getting SS number before searching for projects so applied for SS# and waited.
5. After delays received SS card in March' 06.
6. Found a project soon, but the start date was from June ' 06 and 'officially' joined the company from June' 06.
7. Employer asked for a signed letter from my wife that due to health reasons, she is joining two months late - not sure if it is purely for their safety or ours?.
8. Continuous paychecks since jun '06
9. Haven't traveled abroad after getting H1B approved.
9. Applied for I485 together in June' 07 with me being direct beneficiary and wife being derivative. Submitted all documents i., passports, I-94, approval notices, w-2, tax returns, employment letter etc for both.
So the question is not getting paychecks or not joining the company immediately can cause any problem to her I485? I read some where that It is not a problem for H1B AOS as person is not required to join the employer immediately after getting approved for H4 to H1B AOS and it is a problem only if entered the country on H1B and not receiving paychecks in between.. Is this true??
Also, it says on DOS website that employee-employer relation is critical for H1B and employee can be on vacation, sick, out of pay etc. Not exactly sure what it means by relation.
Person, if in USA, has 30 days to start working for H1 employer after CoS approval date. One more thing, one can start working after applying for SSN without waiting for getting actual SSN.
It seems that she was out of status.
