I applied in NSC 485/EAD/AP on July 27th. The case was transfered to CSC. 485 Application was then transfered to TSC from CSC but EAD and AP are being processed in CSC.

Guys,
I had INFOPASS appointment today. We reached 15 minutes before scheduled time. 8101 N Stemmns Fwy - Building does not have visible number "8101" but large "Department of Homeland Security" board is easily visible. At the entrance we showed our infopass appointment letter and Guard told us to stand in a queue behind racks. I saw 2 different queues nearer to Window so curiously I asked the fellow who was right ahead of me and he told me that the queue where we stand is meant for people who have not taken appointment and other queue right across the window is meant for people who have taken an appointment. There are no sign boards for these 2 different queues. Guard misguided us so all in all we wasted 5 to 7 minutes I came out from that queue and stand in the right queue again. At the window I was asked for Driving license and purpose of the appointment. I showed driving license and told we filed AP in July, 1* but have not received it. He demanded I-131 receipts and I represented them. Then he gave us tag numbers for all family members including myself. Then we moved towards the main entrance of the bulding. Guard instructed us to remove wallet,pen, anything we had in our pockets, purse,belt etc (Cell phones are not allowed inside the building) and put in one bucket which was scanned through the machine like available on airports. We had to walk through metal detector and then took possesion of our belongings and then waited in the waiting room for approximately 15 minutes. As our tag number appears on the electronic board with assigned counter number, we went to the counter. Lady officer greeted us and asked the purpose of the appointment and again I represented infopass appointment letter and I-131 receipts and told her that I have not received our advanced parole yet although we filed on July 1*. She dived into her computer and said your all Advanced parole are already approved on 10/1*/07 (Which was the date of first (And only one) LUD on our APs) and already mailed to you so she can not issue either "Original" or "duplicate" Advanced parole. According to her I should be receiving them any day now. She herself wanted me to give me the info about EAD status without myself asking so I told her that we already received our EADs and then she asked me, do I have any question for her and I said yes, what would be our name check status and she again digged into computer.According to her my Name check is still pending and I should inquire again after 4 months by taking another infopass appointment. Upon my further digging she told me that if everything is "generally clean" then 4 months is a standard period to get name check clear so she suggested me "inquire after 4 months". According to her my family has already cleared name check.

Arent you concerned that if its approved on Oct 1, and you didnt get it, then where is it? Did you ask them as to why you havent gotten it in mail even though it has been approved a month ago? Also, did you check with your lawyer if he got anything?

Ya...Atleast, they should allow us to file EAD. In that case my spouse can work. She did not get H1b this year(because of lottery system). She has PHD in CSE and sitting at home.
If she has a PHD in CSE she should look for a job get H1 and file Green Card in EB1 all off this can be done in 6 months! What's holding you back???? :)

The same memo also talks about AC21 - to me, it sounds like those who qualify under AC21 can also get 7th year extension even though they are currently not on H1-B status. Could someone please clarify if I can now "recapture" my now-long-gone-H1B based on this memo and the following information?
- I had a H1B visa, whose 6 year period was going to expire in Dec 2005.
- In Oct 2005, I changed to a different employer using AC21 & EAD. So the H1B became void at that time.
Now, under the clarification by this memo, can I apply for the 7th year extension of my old H1B and switch back to that (rather than using EAD to work in US)?

dear members,
dint had much time to go thro' your responses. but if senior ppl are targetting this fellow( mercies) for this thread, then i beg to differ. because as a member of IV, i have been answering "hadron" posts too at immigration portal.
I think all Mercies is trying to do is help IV out, by preparing answers of such questions which stupid ppl ask, so they can be put to a stop right away. Probably he's drawing your attention to some q's that all of you have answers for, just guide mercies to that post,
but i think all of your remarks have been directed towards merices only as if he's started it all.
i guess we outta stop ppl who are trying to defame this collective effort by giving them one-point answers.

Exactly! I go by a different user name at Immigration Portal, and tried my best to counter hadron's posts. I only created this thread after I saw that no people in the know were countering this guy. I am a foot soldier, not an officer.
The post from rags4u is exactly what we needed. He and another IV guy is engaged in getting things under control, as I wanted.
I wonder if this person who did all this posting without reading what is posted on the site and wasted the valuable time of IV volunteers from an anti immigration group? Please do not get distracteed guys and all those people sitting ont he edge, join in and act!!
As for all of you guys who raise the scare of anti-immigrationists at the drop of the hat - go thru all of my posts, and you will find I cannot be from numbersusa. You can also check with IV's officers and they can get my name/address from my contribution check already deposited in IV's account!
Please try to counter propaganda wherever you can - that's how we will get more people to join! Efforts like mine do not waste time - they serve a purpose!

The only leeway USCIS has w.r.t EADs are the duration of the EADs and not the timing of the issue of the EAD. The fact that the EAD can be given only after the I485 is filed is governed by the INA.
Further the grant of EADs in all the eligible categories is more or less the same. Even if the timing of the grant of the EAD were in USCIS hands ,it is hard to request an alternative interpretation of the regulation in some cases (eg after I-140) while retaining the same interpretation for other categories (eg EAD after completion of Education). This just opens up a lot of loopholes.
ON top of all this we have to take into consideration the huge inherent inertia of the USCIS to change. As already pointed out the only recourse available would be to change the law of the land, on which path we are already traversing.

I hope too, school districts hire teachers between june-sept and judging by the speed last years quota was gobbled up, I can hardly hope to get a job as a teacher 10 months in advance...

hmm, i think munnabhai did the right thing.
sometimes people give irrelevant advice. one guy asks im getting divorced, what shud i do with respect to 485? if people tell him, stop worrying bout 485, focus on ur life and fix ur marraige, then its not helping him from a "forum" perspective.

Yes, your point is entirely valid. I didn't know about this cross-country provision. Another unfair provision.
In fact, my point was that unfairness should be dealt with on all possible fronts. If the system works properly, nobody will need to do anything that is even remotely unfair.
I have a strong gut feeling that 2009 would be a good year for EB3. They will start approving more cases I think.
I certainly hope for the best this year. My PD is currently current, but I am still helpless. Can't file a service request nor know any kind of status (unless on pure luck I run into a good natured IO over phone or infopass). Just have to pray that they find and get to my application while dates are still current.
This thing is a dual headed monster....If you conquer the PD head, the processing date Head pops up and vice versa.... I was in same situation briefly ( a month or two of PD being current but Processing dates stuck at July 2, 2007 at NSC) early this year and had to sit back and painfully watch the PD for EB3-I becoming 'U' again. I am more afraid of the 'unavailability' than retrogression now!! With retrogression you can atleast hope it might become current in the next month or one after that. But with 'U' , you just have to wait until Oct next year !!!
The moment they advance the PD for EB3 I and my application still remains untouched , I am gonna try to take that info , take an Info Pass and ask the IO, if they had advanced the PDs, it means they exhausted every application that could be approved and wanted to find more....so what ever has happened to my case !! I got an automated response from ombudsman saying that I will have to fill out a formal inquiry in the form of 7001. That's the form to fill out if you want ombudsman to inquire into your case.

Although the issues are true, I would still prefer having absolutely correct articles, so no anti-immigrant could point his/her finger saying "look, immigrants are spreading lies". Just like we bashed them when they were claiming that we pay less taxes. It was a good point to discredit them.
