    Why did yuor wait so long to approve I1-40?

    Sorry if this is a stupid question, I am a new member

    My PD is 02/01/2005, my labour cert got approved in 03/01/2006,

    I applied EB3 I40 on 05/18/2007 and got approved on 05/23/2007

    Considering the scenario is my I140 invalid?

    Well, what is the point in saying it now, he should have said it in the 90s and early 2000 when industry was booming and people found a career path in coming to the US.
    Right now, so much work is outsourced and it is continuing. Very difficult to get a IT job in US on h1b and IT consulting on h1b also facing so many hurdles. For any new immigrant on a software job who wants to get a h1b visa and green card - it is not an easy task.

    I do not know in which city of India you took out your PPF.,
    But I heard you have to pay atleast 5% to get PPF back in Hyd.,
    Hope corruption will not be that high by next 20 years in India!!
    I can attest to that. It's not unusual to have to pay bribe from 10-25% to get the PPF money. And even that takes weeks/months to complete. I've personally known relatives in India who had to do that. It's not even considered anything out of ordinary there. Good Luck R2I's.

    I had an infopass appointment in NY to get information on my case (specifically concerning the FP/Name check status, have received my EAD, AP). Although the officer was very courteous and seemed patient, he thought I had come there too soon for the inquiry. I got very sketchy information. He said one should wait at least 6 months after the 485 RD (mine is June 2007) before beginning inquiry (shoot me, I went a month too soon), and that it usually it takes a year (or more) after FP to get the GC, so I should not worry too much about my case for at least one more year.

    He said there is nothing to worry about and that there are �many small small things� that have to be taken care of after FP and FBI name check clearance before one gets the GC. I asked him what are the other �things� that need to be taken care of following the clearance on name check, but didn�t get an answer (�just small small things� is what he said again). I had to repeat my question about the status of FBI name check on my case three times during the conversation before I got an answer which was vague anyways (nothing�s been done yet). I was hoping to get some kind of information with regards to the status in terms of the search results (no record/hit etc.) but I didn�t get any information at all, so it was a disappointing meeting for me.

    Some pointers:

    *Have your print out of the appointment confirmation ready before you enter the building-the security officer outside the building checks it to verify that you indeed have an appointment there.
    *The queue at the entrance for security check was long, so make sure you reach there well ahead of the scheduled appointment.
    *There is one more counter in the lobby (and one more queue) where you get your token number for the infopass room. They asked to see the appointment confirmation receipt here as well.
    *The infopass interviews are held on the third floor. I waited for 30-35 mts. before my number was called.

    P.S. Received EAD card at home address and AP documents at the law firm address.

    I can scarcely believe it... Although I have to say that it would have been impossible to choose between the two entries. Perhaps this is the fairest result in the end. :)

    Actually, I think results from three battles need to be put up - this one, the cartoon characters one and the line art one. Are there any more that haven't had the reults officially put up?

    been 90+ days no news on AP. called USCIS for delay and now I get an email about RFE on me and my wifes AP.

    any ideas, what type of RFE's being issued for APs?

    my non-lawyerly suggestion: do not file ac21 until well into whichever job you takel

    I have read on various forums that there is no necessity to notify unless there is an RFE, but to maintain appropriate evidence at all times. you may want to consider doing that until you are well settled in whichever job you take.

    by the way, what is your PD?

    Anyone invoking AC21 with unapproved I-140?


    It is risky to change employers after 180 days before I140 is approved. If it comes to issues, when USCIS realizes one changed employment before I140 was approved, USCIS needs to verify that the underlying I140 was approvable at the time the change of employment occurred. By approvable it means that at that time there was no reason to issue a major type RFE for pending I140. If, for instance, the USCIS notices that at the time one invoked AC-21 and I140 was not yet approved and the I140 petition did not include (or included incomplete) educational documentation, it will say that the I140 was NOT approvable due to material evidence missing. And, at that time AC-21 can't work and may cause huge issues. One should be very wary of this and in general attorneys advise to wait until I 140 is approved before invoking I140.

    Requirements to change employer when GC is pending:

    It is best to not to change to an employer offering you anything less than the wage rate specified in the GC labor certification. On the higher side, it is better not to take up a job that offers more than 4% more salary of that specified in the GC labor certification. It is hard to resist 20-30K higher salary, but one would have to resist the temptation for taking the job offering higher salary. Otherwise, there is a risk of USCIS denying the GC application.

    USCIS doesn�t account for dollar appreciation or devaluation. USCIS also doesn�t account for annual inflation when calculating the wage rate. So even if your labor certification was applied in 2003, you still have to continue at the job with the salary specified in the GC labor certification. If GC application takes another 5-7 years, then you have to continue with the salary specified in GC labor certification application.

    One quick question about salary limitation. Where is this mentioned. I went through the following link posted on this thread earlier ( see below). It says clearly no restrictions on wage. Please suggest, why is this a issue.

    No. As explained by the INS in the June 2001 Interim Guidance Memo, the new job does not have to be at the same wage level, nor is there any requirement that the new position pay a rate equal to the "prevailing" wage. The only restrictions are that the pay must be sufficient to demonstrate that the person will be self-supporting and not become a "public charge."

    that's what happened with us as well.. Waiting for 80 days now on AP and already changed the tickets twice..



    ramus, i dont think local office will issue AP unless its an emergency. I am saying this bcoz i was in the local office today and they made it clear unless its absolute emergency AP will be issued only by NSC. In case of emergecy you need to show a valid proof that someone in your family is seriously sick.

    I got 2nd finger printing notices for me and my spouse (attorney got it and sent a scanned copy). Still have not received RFE notices (neither my lawyer did). Looks like the FP notices were generated on 02/12 -one day before the RFE status

    Thanks for another report of using AP without problems. I agree with you about conflicting reports from the German mission and airports. Based upon my research, the airlines only need to confirm that the destination country will allow you entry. While going to India, we have a passport and while coming back to the US we have the AP, so it is a simple matter. I don't know why they have a hundred clauses and sub clauses to determine who needs a transit visa. I am also going to carry my I-797 notice of action which is valid until Dec 2011. That should suffice in my opinion. Thanks to all for clearing all the confusion on these forums.

    No one is blaming IV core my friend, but we all need to unite and do something big. We cant just wait for our partner to do something.

    Yes, we should hold a rally in March in DC, and what we should do is, members who agreed to come and join us good enough,


    The ones who are lazy, can continue to be lazy , you all have seen the bulletin and EAD is not green card. You are welcome to take your lazy chances,


    I thought INDIANS were to stand together and fight a battle, this is a battle for the justice of immigrants in this country. I understand and I am versed with life in America, it is stressful. But think for a moment,will the green card make it better? If yes then join us.



    This time we will use a different approach.
