    Man, are you serious in asking people not file in time when the topic of the day has been the possible retrogression mid-month in July? And that too on a forum where there are more posts about how to save $3.99 on passport photos than on core team pleas about calling the senators??

    as per the certificate you completed the degree in June 2002 and you don't have five years from that date so it is tough now, filing for EB3 was a good option.
    Talk to the lawyer and see they can correct it at this stage

    Ok, I've seen a lot of threads about go to the rally, actions items, I've reading a lot of guys saying dont ask for your receipt status, dont waste your time etc, etc.

    Yes we did the rally we were great with all those signs, and appearing in the Indy TV but...

    Question remains open:

    1. When are they going to increase the GC quota?
    2. When congress id going to do something?

    I've the feeling that that's it we made our point but we are still with no GC, waiting receipts..............

    What was your RFE for?

    I am still waiting to see what my RFE was for.
    I had another LUD today as well (2/17) (also had one on 2/10, 2/13). wife only had 2/10 and 2/13.

    India definitely needs a F-22 like aircraft considering the Indian AGNI-3 is still not operational and there is no proper long-range nuclear weapon delivery medium. Sukhoi's and Mirage's are no F-22's.

    Hello Everybody
    This is my first post. I worked my ass off to get a favorable
    solution for retrogression during the budget bill. But as everyone knows it was defeated in the house reconcilation. I'm not being pessimistic but my gut feeling is that eventhough senate comes with something, the chances are slim that the house would agree to it. Sensenbrenners bill which house passed has no provisions for EB immigrants and backlogs. I'm pretty sure all of you are aware of Mr. Tancredo's fury against immigrants too.

    Having said that I dont mean we have no way out. We have to work very very hard. We have to raise money and do some hard lobbying. But above all we have to get our employers to back this issue. With all of the above reasons I think it might be a very bad idea to guess we would have any favorable legislation in a shorter span of time. So we have to plan something for a longer period of time and execute it very diligantly, I guess.
    I think Immigrationvoice is on the right path... Lets face it people!!!

    it probably means.. they are opening each and every mail they have recived and checking if the docs are in order or not..if they are.. they file it...else they send an RFE...

    i dont understand..how someone can be so f@#$% dumb as not know this simple procdure..

    there are so many posts..i got a LUD what not.... its annoying...
    its like.. USCIS touched my lu(n)d..will i get a GC now..

    I got LUDs on 2/10 on both mine and my wife's 485. My wife got an RFE email on 02/13. I do not know what this means either...

    The original intent of labour substitution was not bad. If you understand that EB immigration was designed with the AMERICAN EMPLOYER and their needs in mind you will understand why labour substitution was allowed. It was a way for american employers to get employees in critical shortage areas and keep american industry competitive. It really was not meant to either be fair or not fair to you and me. If you understand this then it all makes more sense.
    That was then and this is now. So what has it evolved to?
    Labour substitution became a bargainig chip, for employee/employers. It was bought and sold. It was used, abused and misused and done so rather widespreadly. It started to be used mainly by Desi Bodyshoppers. In some cases for friends and even relatives, to the extent that AMERICAN employers and their employees became the ones getting hurt/delayed by it.
    So the rules were changed. Those of us who went through the traditional channels realise that those of you who took labour subs. did nothing legally wrong. Simply understand that we cannot and will not have any sympathy for you if and when something goes wrong.
    As for the folks asking people not to give their opinion. Please post in a private forum then.

    You can bring UP TO 4 spouses on H4 visa. That's why it is called H4. Similarly on F2, you can only bring 2 spouses, Ah...students do not make that kind of money to support more than 2 spouses. USCIS thinks so much about us.

    I am just talking out of my A**.

    Folks, it's a good thing you guys are doing a grassroots drive. But please keep the chatter out of the public forums.

    Anti-immigrants prowl on IV as members. If they get an hint, you are meeting any Rep./Senator on some day, they'll bombard that office with phone calls, E-mails and faxes same day or next day. It will in effect nullify all your efforts. It has happened in the past and it's sure to happen in the future.

    So, please excercise due caution. Do not share information with the folks you don't know very well. These kind of actions are best suited to be carried out in your state chapter mailing-lists, where members are screened before joining. IV forums being public anyone can create a fake id in half an hour or one hour. It's not secure to carry these types of actions.

    In my case my GC sponsoring employer had consent signed from me before filing my GC that- I need to work for them for 1 yr at least after getting my GC. Otherwise I need to pay them all legal expenses they have spent on my GC process if I leave them before 1 yr.

    Is this legal? my employer is top 5 IT firm. (Big pockets to fight anything like this)

    I filed my 485 in June 2007 in Nebraska and yesterday my LUD changed but there was no message. This is the first change in my LUD since my finger printing in July 2007. I am EB3-I with PD of Dec 2002. Not sure what got updated. Any ideas???

    I've got LUD on mine and my wife's 485 on 02/10/2009. So far I got nothing, RFE or finger prints. My previous LUD on 11/26/2007.

    Also, I applied for AP and I had LUD on 02/09. So I wasnt sure if they just checking for 485 before approving my AP>

    FearOnlyGod it is, do not give into bad employers. I looked up google for complain DOL against employer harassment. If you have email or other proof of his recent harassment it can be added to the same complaint to DOL check more resources you should be getting your pay.

    Q. What if I believe my former employer is "black-balling" me when a potential new employer is calling for a reference?
    A. This is not necessarily illegal. However, if the employer is doing this because you filed a discrimination complaint against them, this could be considered retaliation and that is covered under the Missouri Human Rights Act.

    It would help if Masters is only counted from the Acredited Univs...

    I am sure they will take care of that loophole... the fact is , even NJIT is an Accredited University. The Degree is not worth the paper it is printed on though.

    In any case, as long as its not an Online degree..it should be permissible.

    Tension that I have gone through on Friday, Saturday and Sunday: Can't estimate the cost
    Frustration that I am going through since Monday Morning: Can't estimate the cost.

    Please note that I am not counting any cost for taking the time off from work, spending time on collecting documents, phone call made to my parents in india. I am not even thinking the opportunity cost.

    My parents had spent time and money going to the different agencies to get the affidavit and then sending it to me via courier. My parents had cancel their program so that their son and Daoughter in law and son in law and Daughter can get the paper quickly and can send the papers to USCIS.

    Ignore it. Even I had the same problem. Goahead and certify.

    I can not certify the form. Even if I certify it comes back with error and tells me to enter middle initial. Tried couple of times, but without any success.

    Dos anyone has any idea?

    Be on the safe side man... Get her here atleast one full week in advance and have her medicals done here. Dont take a risk for few $$$$:)
