May be it's true that labor and 140 belongs to the company, but they just can't take money from employees and sell it to someone.
Sure, they can. There was nothing in the law forbidding them from doing that and they abused the system badly which has resulted in a permanent ban on substitution.
You cannot do anything about them using the Labor for someone else. Perhaps you can do something about them taking money from you to file 485 and failing to do that. If you can prove this with a clear paper trail, then you stand a good chance on this one.

Note: These details may be true. Last month we had heard such information but not in detail and thus had not posted it. We were hoping to get this news within 6-8 weeks (As per oour note on http://immigrationvoice.org/forum/showthread.php?t=14749). There are efforts to make name checks current and that is good news for everyone waiting for several years in the namecheck blackhole. Someone I know was EB3 I Aug 2001. They had filed for I-485 sometime in 2005. They got their GC on 12/22/2008.
Their lawyer filed a Writ of Mandamus against USCIS in Aug 2008. The deal was the USCIS was to either approve or reject their case in 60 days.. So, check with your attorney and see if filing a case in an option for you.

AC 21 is complicated, the whole GC process is complicated. Lot of us are thinking 180 days ahead for changing employers.. please think about September 18th. We need to make a difference. Bottom line is that u got screwed. Labor is for a position with your employer. He may choose to give to anyone he wishes. Labor substitution thus was not illegal act on his part as it was permitted by the law.
I-140 is his stuff .
I-485 is ur stuff but in absence of I-140 it means nothing.
Your only case is if he has violated any of the H1 provisions.

OK guys, here is what I think. Being in US on a visitor visa, and then applying for an I-485 does seem like a violation of visa terms, but the other way round seem to be fine. I mean she can apply for an I-485 first in India, and then apply for a visitor visa later while her I-485 application is pending. While applying for a visitor visa she just has to honestly tell the consulate officer that her I-485 is pending and there should be no problems.
If she applies for I-485, she has *beyond a shadow of doubt" expressed immigration intent. Her visitor visa request will immediately be rejected.
If this is not so, then it means that all those who have filed I-485 in their home countries through consular processing route are in effect barred from entering US till some decision is taken on their application. This sounds bizarre. Does not make sense. What do you say?

as per the info u provided u'r...... mail dt is 8/17/07 & receipt dt is 9/26/07...... did u'r application reach cis after july visa bulletin..... if yes, then it appears that with u'r april-06 dt. the priority dt was not current when they received u'r app .... is that a possibility.....
even if thats the case they cant go back after more than 2 years ...they simply cant decide after two years if something wasnt filed in time - even by uscis' horrible standards that'd be a new low

Almost all holders of the CA have a 3 year BCom. We have had, as far as we know, 100% approvals showing the CA = US Masters with the proper documentation and a professor's expert opinion letter. Also with AMIETE.

So my old company's lawyers got my Denial Notice today. USCIS is unbelievable in their incompetence. I got denied because apparently I filed when a visa date was not available. Why would i do such a stupid thing? Obviously the IO didnt take the time to do a little research to see why I filed when I did, nor did his Director who rubber-stamped the denial.
My I-485 was filed on August 2nd, 2007. The August 2007 visa bulletin released on July 12th, 2007 did indicate UNAVAILABLE (http://travel.state.gov/visa/frvi/bulletin/bulletin_3269.html). However, USCIS, amended that a few days later with an update allowing a month (through August 17, 2007) for all individuals who were current as of the July 2007 bulletin (including me) to file. It took me about 1.5 minutes on Google to locate the Update Memo. To think that an IO cannot locate this essential memo and would blatantly deny a valid application is beyond me. This is insane that an organization as important as the USCIS can be so inefficient.
I called their customer service number to see if i could resolve it in a simple manner. The jerk of an IO I spoke to said "you are not going to like what I am going to say, but you are currently out of status (since I am on EAD and AP) and will need to file an MTR. People may tell you to not pay the fee for the MTR, but I recommend you do, since that is the only way your case will be reviewed"
