I don't know why some people here are taking this work based immigration here as an all out war. As it is, working and staying in the US or any other country for that matter by foreigners is a priviledge, not a right. No one forced us to come here, we came here on our own free will.
Regarding the description of discrimination of job based on country, that's rather ridiculous. There is no discrimination when one has the right to work and live in the country, that doesn't mean that anyone from any country can just come here and work with or without authorization and say it's discrimination. How about the many Indian companies who hire only Indians? Aren't they practising discrimination and fraud? They don't even bother to try to find qualified people in the country, rather they just issue H1Bs right way to Indian nationals only by just declaring a bogus "can't find qualified people in the country"
If we want good things to happen to us, we should be fair and not misuse and violate the laws of the country. We all have a choice, we can either stay here and be honest and follow the laws and rules of the country, or if we don't like the way things are here we can just go back home.
Sorry to be so honest, but I am tired of every other person cribbing about being victims. Looks like everyone wants to be a victim of something, it's time we take personal responsibility. If we don't like it here in the US, we have the choice to go back home. No one is forcing us to stay here.

Seriously I agree with you 90%. We should follow the rules and there are definitely companies and persons abusing the system. And these type of persons sometimes themselves were once immigrants waiting for green cards.
The 10% that I do not agree with is associated with the reality of working in a country for so long (6 or 7 years) but still not getting the green cards.
You are right that nobody force you to come here. But you decison to come here is based on certain assumptions (such as getting a green card within a reasonable timeframe and in an orderly way). But because of the chaos of the whole green card thing right now, you may not be able to get your green cards within a reasonable timeframe that you had planned, not because you screwed up (say changing the employer or making a huge mistake in your work). Rather it was either your employer or those government agencies screwed you up. I think it is really the chaotic situation, where honest, hard-working people who patienly wait in line are not getting what they deserve, that make people mad.
Everyone probably can think of many examples of such "unfairness". Truth is that the situation has come to a boiling point that people can hardly stand any more, esp. when the July VB fiasco happened.
To go one step further on your point, the whole world should have a better understanding and expectation of employment-based immigration to America. When the fact is out, it is really up to the indivdual to make an informed decision without complainting.

Hi Guys -
I filed my I485/EAD/AP at Nebraska on July 24th, 2007. Got receipts for all of them on September 19th. Done FP on October 23rd for myself and my wife and saw a LUD on I-485 a day after. EADs were approved and received on October 10th. But i have not received AP yet. Looks like my application is still with NSC. Never got a transfer notice or anything and online status also shows "Case received and pending at Nebraska".
There is only one LUD on AP and that was on September 21st. Nothing after that.
Anybody in the same boat? Do i need to make an infopass to get more information on this. I need to travel in December and want to make sure i get AP before that.

It is not a mistake. Logically, ROW eb3 should not even be retrogressed.

Is there any update on three bills in house. I have checked the hearing schedule for all committees and there seems to be no hearing scheduled for any of these bills. House is in session till September 7 and after that District work period and convention shows, which leaves us with just 4 weeks from now and after that It reconvens from September 9 with target adjournment date of 26th september and i m pretty sure no congressional rep will like to cast vote on any bills before going into election....
Prospects seems bleak now... Is there anything we can do...any last attempt that is required? If so...Let us all know...

Being a big company they may have their own IT dept. If we can find out if they either outsource their IT dept or hire H1-bs than he may not have much to argue..my 2cents.

I got nothing else to say besides that I concur with every word you said about highly skilled population. They get so caught up and satisfied with their small satisfactions, that they tend to ignore the bigger picture. At times, I think USCIS just fooled us and gave in July07 to shut us up. Yes the right work is shut all us up, like those small beggars who beg on the streets and you give them 2Rs to shut them up.

So those guys who attended the hearings or met with senators. what was the result? what did they accomplished? did they get the opportunity to participate with the senator or law maker in an action plan? or we just wasted that opportunity asking for autographs? please those guys post your comments. - I strongly object to the language used in your post. Loo can be used as platform to expose false media. I think there are lot of media groups which do not get enough funding from politicans and they will make news about our issue to get their ranking higher. And above all our friendly Fox, MSNBC. CNN will soon kick Loo
The idea is - use this guy and expose media that gives false news or that supresses real issues and force those types of media to bring our issue to limelight.
I have heard all media saying "We are immigrant nation", "we need skilled immigrants", "'We are not racist", etc.. then again the same media says "Immigrants are overstaying visas", "There is quota, we cannot do anything", same media has supressed microsoft's news about the Canada development center just because it involved immigration.
I am of a strong opinion that media is controlled by politicians, the reporters who said they will cover the flower campaign - chances are that their bosses may ask them not to or give them another assignment ???

But this is USCIS. To calculate 21605-20000 they need full business day. Jokes apart they haven't mentioned. My guess is probability of winning lotto on Masters quota would be far higher than on regular quota. I could be wrong.

When I immigrated to the US, I believed that this country was a meritocracy where you were judged based on your abilities and qualities. These country based quotas reward people depending on where they or their ancestors were born. This causes people from India and China to wait over a decade to get a green card whereas someone from another country with similar or lesser abilities can obtain permanent residence in a very short time (about an year).
Since these EB category based green cards are awarded for professional skills, imposing a country based quota just does not make any sense. I urge you to work with Congress and change this unfair policy and reinforce that America is truly a society that celebrates meritocracy.

I have been in the US for over 10 years. I work for company ABC, for which I am happy to say, I recently wrote an algorithm (patent pending) which brought in about 10 million dollars worth of contracts to my company.
I have paid $xyzn federal taxes, $xyz in state taxes, $xyz in medicare taxes & $xyz in SSN taxes over the last 10 years. There are my monetary contributions to this country.
I was privileged to have volunteered in your 2008 presidential campaign. I was and am inspired by the new politics and policies that you talked about. A legal immigration fix is something that is low cost high benefit for the country - so I implore you to make this a high priority.

There are many people who would just run away from effort when doubts are raised and since people of afraid of being punished for just advocating a public policy or writing a letter to congress in the first place. I would request you to not reproduce posts here or on portal that would echo the material the plants fear and doubts among members.

I understand that there is lot of fear among applicants that USCIS might retrogress the dates interimly sometime in july due to the expected high volume of applications filing in the begining of july.
To minimize the chance of USCIS from taking any such steps, shall we all unite and file the applications on a specific date in july probably on 30th of july? This will accomodate all applicants...so that we shall all be winners and use this opportunity to our advantage instead of competing amongst each other...where only a few will be winners and others will be loosers.
This will also reduce the pressure among applicants , attorneys and doctors.
Can the AILA cooperate? Will there be unity amongst applicants to make this possible??? any ideas ??
