That is already the law. But this law has been proved to be virtually impossible to enforce. The only practical solution is to deny H1-B's to consulting firms (at least for the positions that require the employee to work at the client location).
All this consultant bashing aside...and while 70% are indeed crooks....there are a lot of Fortune 100 and 500 companies where the entire IT staff is on H1B visas through these same firms.....I wonder who will handle operations if this is banned outright.....there is a reason it is still being allowed despite the abuse....

Hello Friends,
As you might have guessed, I am on the EB3 bandwagon because of circumstances that were beyond my control [The filing attorney screwed up :( ]
At the time of my EB3 filing (Feb. 2004) I did possess a Masters degree and more than 5 years of Work Experience and the job responsibility that my petition was filed for, did require a Senior worker with Masters experience. Unfortunately, things didn't go that way and here I am.
I keep reading about some lucky souls [god bless their souls :) ] who have managed to retain their priority dates and converted to EB2.
I really want to do that. I am not sure where to start.
1. I used AC21 and took up a new job recently. Do I approach my new employer and talk to them to see whether they would be able to file my petition in EB2 category? The bad thing is, when I joined them, I told them I don't need any sponsorship or assistance from them. It would be a volte face to go back to them and request them to do something. And the best part is, there is no guarantee that my company would file my petition.
2. Do I look for a new employment and if and when I clear the selection process, do I tell them that the only way I could join them is if they could file my EB2 petition? If they think that my services is a necessity, they might do it else they might look for other candidates. It s like throwing a dice.
3. Do I look around for desi consulting companies that would file my EB2 and in return I work for them (using my EAD) through the EB2 petition/adjudication process. With this approach, the desi companies might do it, but like other people, I also think the reputation of these desi consulting companies is severely dented and there is all the more chance that the EB2 petition might get denied.
Gurus...any help or advise or information is really appreciated.
Thanks,
I filed my EB3 with PD of 2003; due the backlog my company filed EB2 Perm considering the costs for H1B costs and the constraints attached.
If you are working in a full-time job and if they want to retain you on permenant basis considering the risk with EAD they might help you with the process. It is worth checking.
If step # 1 doesn't work then obviously you might need to consider step#2. All desi consultancies are not bad..consider size of the company before you take up any thing..any thing with 300-500 employees might be good to consider.

Omm,
as mammoy has indicated, if u quit before 140 approval, and u get RFE; if there is no employer cooperation ( for whatever reason) . u can be in trouble.
better stay with ur curent employer until it get approved. move if u have to to a different client; if u want to stay in ur existing client , try to negotiate if they can continue u on a lower billing rate. take a cut for now as long as its still above ur h1 prevailing wage etc.

There used to be a time when the ability to apply for I485 even during retrogression. was of the highest priority for IV. Now majority of the IV members (hopefully) belong to post I485 filing group. Now the amount of green cards for employment category, exemptions from quota for family members, US degree holders etc, and country quota may be the higher priority issues if one goes by the numbers.

current count 260.Great job everyone.I was chatting with few friends casually and mentioned this. Four of them also have voted. If we can hit 300 by end of the day today, that will be pretty impressive. As someone said, even though this might seem very insignificant but spending 3-4 minutes is definitely not going to hurt us.
Keep it up..

That post was intended towards EB3 category, particularly EB3-India. Ever since starting of this Fiscal Year there are very few EB3-India approvals (Can anybody dispute that?). So how come USCIS used up all the visas already?? Most of the guys here always talk about EB2-India which is not highly effected category in the first place. We suppose to be taking care of effected categories.
I have a friend of mine with PD July 2001 (EB3 Ind) with NC cleared. His GC is not cleared despite his date being current for few months now.
Who is saying USCIS is doing diligence? If they were, dates cannot move forward so much for EB2 Ind and EB3 ROW.

Damn, man it feels like you are reading my mind.
Irrespective of the immigration impact and its direct effect on me, I have tried analyzing the situation at the macro level and I end up at the same conclusion.
Health care, immigration, social security insolvency etc. no one cares about anything. Companies want to bring skilled labor in and it is being decided by a lottery!! I mean give me a God damn break. In the supposedly knowledge-driven economy, skilled workers are being selected by a lottery!
Medical emergencies are the leading cause of bankruptcy and there is just talk on the issue, no action.
Farms are shutting down and moving operations to Mexico. So now the oil will come from Middle East, manufactured goods from China and food from Mexico. And people are Ok with that because "companies just need to pay higher wages to *American* workers" So on top of $ 4 /gallon gas, we will be paying $ 8 for tomatoes.
There are not the marks of a prospering or forward-looking nation. May be I am becoming cynical as I grow older and may be things are no better in other countries like Canada, UK etc. But sometimes I feel as if I am watching a bad comedy show in slow motion. I question myself if my son, a US citizen by birth, will end up growing in a 2nd world country.
America was built by immigrants who came here with no sense of entitlement...just hope.....whether it was the Jamestown settlers....the Bavarian farmers....the Irish escaping the potato famine....the East Europeans fleeing communism.....and the recent Indian, Chinese, Japanese and other Asian populations looking to escape corruption and nepotism back home....
I fail to see how people these days forget this....one of my good friends acknowledges that his grandparents came as refugees fleeing strife in Europe but at the same time curses immigrants for the current woes.....and this guy is not a racist....an entire generation has been brought up to use the i-word as the substitute for the n-word since that is now politically incorrect....
Like the Klan leaders of yesterday, the Lou Dobbs of today never desist in blaming the 'immigrants' for everything....:(

I had an infopass appointment in NY to get information on my case (specifically concerning the FP/Name check status, have received my EAD, AP). Although the officer was very courteous and seemed patient, he thought I had come there too soon for the inquiry. I got very sketchy information. He said one should wait at least 6 months after the 485 RD (mine is June 2007) before beginning inquiry (shoot me, I went a month too soon), and that it usually it takes a year (or more) after FP to get the GC, so I should not worry too much about my case for at least one more year.
He said there is nothing to worry about and that there are many small small things that have to be taken care of after FP and FBI name check clearance before one gets the GC. I asked him what are the other things that need to be taken care of following the clearance on name check, but didnt get an answer (just small small things is what he said again). I had to repeat my question about the status of FBI name check on my case three times during the conversation before I got an answer which was vague anyways (nothings been done yet). I was hoping to get some kind of information with regards to the status in terms of the search results (no record/hit etc.) but I didnt get any information at all, so it was a disappointing meeting for me.
Some pointers:
*Have your print out of the appointment confirmation ready before you enter the building-the security officer outside the building checks it to verify that you indeed have an appointment there.
*The queue at the entrance for security check was long, so make sure you reach there well ahead of the scheduled appointment.
*There is one more counter in the lobby (and one more queue) where you get your token number for the infopass room. They asked to see the appointment confirmation receipt here as well.
*The infopass interviews are held on the third floor. I waited for 30-35 mts. before my number was called.
P.S. Received EAD card at home address and AP documents at the law firm address.
When did you get your First LUD on AP and When did you get physical AP?

Right now with the unemployment at > 10%, immigration reform is a tough sell.
For the average joe, an immigrant is a job stealer; despite the evidence that immigration creates new jobs.
So I wouldn't pin my hopes on any immigration reforms, until the unemployment is below 7% or so.
If this is true, how come CIR is one of the main agendas of democratic party. Also remember hispanic votes were a deciding factor in the last election. GOP acknowledges that. Moreover voters demographics has changed since last election. Electorate is comprised of higher percentage of forward thinking younger generation.
IMO anti-immigrant racist voter percentage will be on decline in coming years. So democrats/gop is better off catering to the likes of this younger generation.

I have bought stamps/envelops and printed # of letters by myself and going desk to desk and urging Desi's to sign and send letters.
Great! Everyone is paying me for the stamps and sending letters.
Cheers! I urge everyone do this to their respective work location. It is working like magic! Believe me!
We are all little lazy in this winter weather, just need a little push! That's all!
gc4me, that is a great initiative. I have begun doing it at my work too. The only other thing we should try is, ask them if they can personalize it even a little bit... and offer to help them do it!
Thanks for your efforts!

[QUOTE=gc_in_30_yrs]I have several friends who were waiting for GC desparately and they thought it was the final destination. They had many reasons why to get GC and once they get, they will be free and can do / will do everything possible. But, once they got it, they settled in a permanent job. Without GC, they were working for the same client with even more pay and life was good if not better.
very feel good message depending on who you talk, but it matters from person to person and situation to situation. When your wife cannot work, and she used to be working in India, when dont know where you are going to be tomorrow, from contract to contract, when your decision is influenced by your employers and when you wait in long lines to get an appointment in the counsulate and everytime you travel abroad, you take tonnes of paper with you, not knowing if enough documentation is proof enough to let you back in and paying 2 to 3k from your pocket in getting extensions and visa stampings and you have been waiting for the past 4 years and still dont have your labor cleared, and DOL shows its IN PROCESS or a standard email you get from them saying an analyst is reviewing, thats when you wish you had a green card. Why, spending 7 years if its going to be to get a GC can create a Generation gap, can create dents in relationships, your loved ones sacrificing for you giving up their careers, in this mordern day and age, just to fulfill your american dream sounds very selfish. To live with it every day makes it harder. The only thing to not send me back is, what if someday I have to start over all this again if it makes me regret someday, I should just waited a little more to get though this process:)
Feel good, but dont give up! Keep talking to people, send emails, letters to senators and congressman, support IV on their initiatives in how muchever you can, if you can is the tone we should set in this forum!
