    Just Thought

    There is 200k application without 140 approval, this is including july filers.

    there is lot of chnace for those who got their I-140 approved, even their PD '2006.

    you can see people getting approved PD'2005 EB2 cases, even then VB says now 2004'apr for EB2.They are not processing based on PD now and in future also i gues.Since we have already filed.PD will restrict only to File I-485 in future.

    I think EB2-jan2007 and EB3-Aprl2005 in October VB

    That is wishful thinking.I know people with more recent priority dates got cleared in june but it will go back to PD system from now on again,how else can they do it.The reason why (to eveyone's surprise) they made everything current was to clear some of these cases which were filed long ago(I-485) but were stuck due to the retrogression.This is obviously not going to happen again for sometime since they now have hundreds of thousands of more cases.

    I understand the informational part of your post, but i don't understand the bad news part of it. How does getting a 2yr EAD change your I-485 processing? It will get processed whenever it supposed to be processed next.

    There are ppl like me - EAD is pending for over 3.5 months and there's no decision. Be content with the fact that yours was approved in time and it's icing on cake that it's 2 yrs validity. the way i see it, it's all good news. Point me to the bad news please.

    First off its only informational, so other people know that even with PD being current you can receive 2 year EAD.
    Well, good news because i don't have to worry about renewing it for another 18 months, bad news because does it mean my 485 is nowhere near processing.

    Either way im not fretting about it, when its my turn i will get it. It was just a statement.

    Our receipt date is 9/10. No FP notices yet. Got EADs and APs well in time.
    I opened SR for myself on 10/11 and my wife on 10/16. Exactly after 45 days, today I got 2 letters from them. There is no logic in what I see in them. Here are they:
    Response to my SR: Our review indicates that this case is actually within our processing time. We regret any misunderstanding.If you don't recv a decision or notice of other action within our current processing time, check our website or call cust service. All returned documents will be re-mailed.

    Response to spouse's SR: The status of the service request is :
    Biometrics must be taken at the ASC in your area. When an appt. becomes available you will be notified by mail when and where to report. Please allow 4 months to receive your appt for biometrics.

    Finally the real twist ..... We had an infopass appt at Dallas center last week.The IO asked me the purpose of the visit and I had informed her about our cases. She looked at our cases and said that our files are not yet opened. I was confused and upon my request to explain in detail, she said our files were not assigned to anyone and are with TSC. She suggested me to call USCIS Natioanl Cust serv and ask them to send a request for the files to be opened. I have never come across/read such a scenario. I got further confused and was wondering how come we got EADs and APs when our files were not "opened". There was no clearcut answer for that. She advised me to call them and quote that we visited Infopass and they advised us to call USCIS asking our files to be opened. I am not sure if this works or not.

    But the greatest relief came at the end of the appt ....both of us got cleared in the background check. I am assuming that background check and name check are one and the same. Friends,Correct me if I am wrong.She said as of Oct 18th, we were cleared.
    Looking at all these things, I am not sure how the process is taking place !
    I haven't called USCIS yet as I thought that I would wait till 45 days are over since I opened SRs for FPs. Now it's over and I just got the responses for the SRs today.

    In that case, at least you will have your EAD and AP and can change your blood sucking deshi consulting company after 180 days and can peruse better employment opportunities.

    Lost in the big hoopla of 1 yr jump and hopes of similar advancement for others in May VB are the following facts.

    1. USCIS is about to raise fees for all immigration related procedures beginning from June 1st
    2. Visa quota ends in September and it takes on an average of 4-6 months to process I-485.
    Let me detail 2nd step. If they move dates forward by say 1 yr and thousands become eligible for 485. They will accept those cases, get fees from those lucky souls and make the dates unavailable after 1-2 months. Remember last year they were moving dates by 6 months till they made it UNAVILABLE for August and September.

    I filed my 485 in June 2007 in Nebraska and yesterday my LUD changed but there was no message. This is the first change in my LUD since my finger printing in July 2007. I am EB3-I with PD of Dec 2002. Not sure what got updated. Any ideas???

    Maybe USCIS thinks that our cases mayn't become approvable within the next 15 months. This is just my theory, because I see lot of people have got FP but with early PD's

    Also I agree what Logiclife said when it comes to payments..

    I went thru COBRA for the last 2 months I tell you its a PAIN IN THE A##.
    Yeah premiums are very high. due to some gross miscommuniation on the provider they cancelled my COBRA for december since they didnt recieve payment.

    ONce you quit our current job, you will get within 7-10 days details from ur current insurance cpmpany or a third party administrator which ur company uses. They will also send a payment coupon. (not a discount coupon..).

    I hope your new company is paying the COBRA reimbursements for you...if not there is a loop hole in COBRA taht you can use and NOT pay the payments since you will have grace period. HOWEVER please keep in mind that the new insurance with your new company may have some restrictions on pre existing conditions...so keep an eye on that..since its for 30 days you will get on to a new insurance personally I wouldnt care for CBORA if the premiums are too high, why becuase, remember the coverage is RETROACTIVE, so you can get a claim reimbursed later after within the grace period

    Lou has branded an entire national communiy in his hate filled rhetoric. I appreciate that good people differ in their views on immigration, but this crosses the line. H1b is "cheap Indian labor" and "overstay their visas" ??
    Lou believes in quoting no facts, just bullishly repeating such views. Nobody who disagrees can ever get a word in. I am a specialist physician with multiple degrees and board certifications. I practice in underserved communities, speak fluent English and pay my taxes. My visa status is and always has been legal. Do I meet the Lou standards? I am waiting in an endless line for a green card that keeps me at the bottom based on my country of birth. So much for Lou's cheap labor! Has everyone forgotten his tacit support for outsourcing in his "other professional life"?
    Shame on CNN for allowing this. I, for one, have no further interest in this channel.

    Discover does not issue a credit card if you are not a PR or citizen..even though you have good credit history..

    Yeah! except that they do....the first time I applied a long time ago that was the reason assigned. A few years down the road they invited me...someone called me and sure enough there was the discover card in the mail!

    By the way my mortgage interest rate was a tad bit higher because of my non-immigrant status. My mortgage broker at the bank told me exactly that.

    Got the CPO mail for my EAD. Awaiting spouse EAD.

    EAD Applied: Aug 25th @ NSC E file
    FP Completed: Sep 12th
    CPO Email Rcvd: Sept 22nd.

    I think I am very lucky to get the approval in just 27 days. My spouse needs it more than me though. Hope that gets approved soon.

    This is a very valid point. If employer or his lawyer asks more money in fees for filing I485 it is always better to go thro employer if he files I485 promptly. But if the delay is intention of the employer then use your own Lawyer.

    Desi companies - HIGHLY ADVISABLE TO USE UR OWN LAWYER AND DONT LINK LAWYER AND EMPLOYER - THEY HAVE TENDENCIES TO BECOME BUDDIES BASED ON BUSINESS PROMISES.

    TAKE ALL DOCUMENTS FROM EMPLOYER AND GIVE TO LAWYER. U MAINTAIN UPPER HAND WITH LAWYER.

    485 RFE IS COMMON FOR EMPLOYER- LAWYER COMBO OF DESI COMPANIES.

    Lawyer needs money and employer needs prolongation.

    With rules changing and with CIR reintroduction and with Durbin Grassley amendments - Desi companies will be having tough business in future - they will try to retain consultants in whatever way possible. So beware. These people are sweet in their talk - but they do everything opposite to what they talk.

    This maybe applicable to non desi companies also - this dates becoming current is an acid test for employer's genuinity.

    So be cautious - watchful and get things done in smart way. 180 days down the lane the story is different.

    First of all, not everyone here is from India. Second, not everyone here is from programming/IT background. It is easy to make that assumption, but believe me, there are plenty of non-indians, or non-IT people, and even non-Indian, non-IT people here. :D

    For these, what is or is not happening in Bangalore is completely irrelevant.
    Second, people who are still here have already decided where they want to be. (Which is why they are on the forum in the first place). People change countries for more reasons than just following the next IT boom.

    Anyway, regarding impact on opportunities here, there is a common misconception that companies have unlimited access to talent in other countries, and the only limiting factor is the quota of H1B visas.
    Not true, by a long shot.
    To give a simple example, our company is looking for people in Australia, Denmark, Finland, Canada and UK since the pool of qualified people in India has dried up in our field. Can anyone guess where is the biggest talent pool? Nope, not in Bangalore, its right here in USA!! Not all companies are looking for the cheapest person. They are looking for the best person. And in many cases, the best person is already here, and has gathered more experience over the years working for US companies. But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs. Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.

    When you outsource, you lose this talent pool which is already sitting in your backyard. You may still outsource, of course, but the most cost effective solution would be to hire the top talent already here. This is especially true in professions which do not work very well in outsourced situations, like business consulting, marketing, management etc.

    This is why it is in the best interest of companies to support EB GCs.

    Pineapple .. you hit the nail right on the head. It is a misconception that everything is cool in India. There are a lot more problems than just your salary. Money is not everything . I think standard of living and less corruption , cleanliness and less crowd do count towards life.
