I filed in July and yet to get FP notice.

That's absolutely right.
I personally think Mr. MPADAPA's assumption is wrong. Last year (2008), the spillover came from Family quota of 2008. Spillover from Family or Employment quota of a particular year cannot be given to the following year. So the fact that there is nothing left from the family quota of 2008 doesn't change any situation here.
So, this year the spillover that Employment category can get from Family quota will be the unused numbers of 2009 Family quota.
This is just my thought!

Filed on July 27, we have not yet received FP Notice.
Talked to service center (3rd party customer service) on Nov 16, they have assigned a ticket, they mentioned USCIS will respond with in 45 days.

in fact i think this memo is very favourable.
first of all it has some protections for h1b whistle-blowers.
second it formalizes the 27th, Dec, 2005 into the AFM which is much better.
this memo does not say that you cannot make an AC21 portability request based on a pending i-140/i-1485. all it says is that for the portability request to be valid the i-140 should be approved first. in fact it clearly alludes to the Yates memo and says that section 1 from that memo is valid and consistent with this interpretation. so, as far as my understanding goes you can still use AC21 even if your i-140 is pending.
the one thing though i am having a little difficulty understanding is that it says section 20.2(d) of the AFM will be updated with section (1) from the Yates memo. But the updates to the AFM to section 20.2(d) do not include section(1) from the Yates memo. may be i need to wait for the revised AFM to be published!

Dude you can convert from CP to AOS even after filing for CP. Your CP can be canceled. Vise-versa is more complicated. Even murthy.com had some write up on this. Go search their website.
Talk to a lawyer and stop cribbing here. Your situation is nothing different from others.

2. If CP filers were not contributing to IV because they were not seeing any benefit out of IV efforts; what do you expect from CP filers to win your kind heart? Contribute in every single way even knowing that IV would do nothing to CP filers? How many such great souls do we have among 485 filers who are here just to get their GC sooner (which means I am not talking about volunteers who have GC but still helping IV - kudos to you guys).
Tell the 485 filers that IV will only take care of members whose PD is over 3 or 4 years old and see how many of those birds will still be on the IV tree!
3. There is no sin, stupid logic in CP filers (who are already in the USA) asking for a provision like EAD. And, CP filers are asking for it just because of the severe retrogression we are in. And they would not have asked for it if there was a separate VISA numbers pool available for CP filers.
You are (or were) just a beneficiary in this system like every one else. CP or 485, every one have equal right to bring up their issue to the Govt.

dint had much time to go thro' your responses. but if senior ppl are targetting this fellow( mercies) for this thread, then i beg to differ. because as a member of IV, i have been answering "hadron" posts too at immigration portal.
I think all Mercies is trying to do is help IV out, by preparing answers of such questions which stupid ppl ask, so they can be put to a stop right away. Probably he's drawing your attention to some q's that all of you have answers for, just guide mercies to that post,
but i think all of your remarks have been directed towards merices only as if he's started it all.

Exactly! I go by a different user name at Immigration Portal, and tried my best to counter hadron's posts. I only created this thread after I saw that no people in the know were countering this guy. I am a foot soldier, not an officer.
The post from rags4u is exactly what we needed. He and another IV guy is engaged in getting things under control, as I wanted.
I wonder if this person who did all this posting without reading what is posted on the site and wasted the valuable time of IV volunteers from an anti immigration group? Please do not get distracteed guys and all those people sitting ont he edge, join in and act!!
As for all of you guys who raise the scare of anti-immigrationists at the drop of the hat - go thru all of my posts, and you will find I cannot be from numbersusa. You can also check with IV's officers and they can get my name/address from my contribution check already deposited in IV's account!

I guess since no one wants to do anything about their situation - we can all sit back and wait for another 4-5 years and hope that we get a green card at that time since that is the amount of time it is going to take most of us if nothing was to change in the current process. Yes... benchmarking is good (in many things as you suggest quality, corruption, infrastructure etc.)... but absolutely not in everything as you suggest, some things just aren't comparable given some micro-economic conditions. Further, doing so would also encourage the mindset of aping the developed countries in every department. Remember the India that we see has gone through hundreds of social and economic cycles over thousands of years. It is not a nation that came to being a few hundred years ago and was a developed country (in current terms) many times in the past.
If one learns history then one also learns not to just take a slice of it for generalization! A holistic view of what happened in the past globally and our current state makes one realize the hidden riches and clear shortcomings in any nation. One need not level out it's hidden riches to clear the shortcomings !

This time the open global media made it a big issue, that is about it. When the economy improves and things are better, again your so called glamour comes back. .

I would hate to say this - but was every recovery in the last 2 decades mostly due to a bubble that was created - dot-com, low interest, housing?
There are not many bubbles left to create, and the debt was never this high.
The growth of India should be more compared to Canada, that has a conservative financial system with lot of regulation. AKA no vegas.

However, the offer letter has a clause that is a bit strange and raised some doubts in my mind. Experienced people please comment and let me know if it has a risky hidden meaning. Please note I am not going to take any trainings and would start to work immediately with one of their clients. The clause goes like this.
"Employee acknowledges that the Company may invest significant sums to train and educate Employee and the Company�s investment in Employee would be jeopardized if Employee were to leave the company�s employment prior to the Company�s receipt of the benefits of such training and education. Employee hereby agrees to refund to the Company all amounts expended by the Company in the immediately preceding 12 months for education or training of the Employee if Employee resigns from the employment with the Company or is terminated by the Company for gross neglect of duty, material breach of the Letter or this Agreement or conviction or plea of guilty or no contests to a felony. Employee authorizes the Company to deduct and withhold such payment in full from any compensation or other amounts otherwise owed or payable to Employee. The payments will be due within 30 days of
termination of the employment."

My wife's AP was approved today. The receipt date on the original filing was Jun1st.
Since, we had to visit Canada shortly for a conference, we took the invitation letter to the InfoPass appointment. The person at the counter asked us the fax the documents to the Nebraska office and we did that the very same day.
After a week, we received an approval email.
I also had contacted the CSC around 20 days before the infopass appointment, even though I chose the 45 day options while booking the appointment.
Hope this information helps others.

A US Masters is not enough to make any distinction. There will be a flurry of students to lesser colleges just to be counted as US advanced degree holder. Watch out for spurious universities cropping up here as well. It will become extremely difficult for students to get visa. Right now students have to claim that they will come back (even though there is a separate quota for them in H1!!!!!). It will become impossible to get a visa. People complain of H1 visa fraud, F1 will become a hot bed of frauds.

You can bring UP TO 4 spouses on H4 visa. That's why it is called H4. Similarly on F2, you can only bring 2 spouses, Ah...students do not make that kind of money to support more than 2 spouses. USCIS thinks so much about us.
