    Why cant USCIS/DOS simply release a memo every quarter about how many EB immigrant visas they issued and how many are unused. It does not need to be detailed report like the yearly one DOS releases after the end of fiscal year.

    Visa numbers WERE available July 2nd!!
    We have confirmed with a knowledgeable official in the Department of State Visa Office that USCIS was requesting visa numbers on Sunday July 1st, and Monday morning July 2nd - and that visa numbers were still being issued as late as the morning of July 2nd!

    In fact, close to 30,000 visa numbers were requested and issued in July - through the morning of July 2nd. And we believe that many - if not most - of the requests made in the first two days of July were for applicants whose priority dates were not current in June!
    So how can USCIS refuse to accept I-485 filings received BEFORE the State Department issued its notice that all visa numbers had been used???? We have not yet confirmed the return of any I-485s filed in July. But we do know that applications were reaching the USCIS before the State Department announcement - and while the USCIS was frantically working to use up the entire year's allocation.

    USCIS did not use all visa numbers before July 2nd.

    Did USCIS actually use the visa numbers it requested????
    Historically, the USCIS doesn't request a visa number from the Department of State until it is ready to grant the adjustment of status application. US Consuls overseas request visa numbers the month before they intend to issue the immigrant visa. This is the reason why consuls return about ten percent of the visa numbers requested - and why USCIS does not generally return any numbers.

    In fact, in making allocations of visa numbers, the Department of State factors in an expected return rate for consuls - but not for the USCIS. And the USCIS - before this June - used about 85% of the total immigrant visa numbers available.

    However, already this month, the USCIS has been returning visa numbers. This confirms our earlier suspicion that the only way the USCIS could request 68,000 visa numbers in a matter of weeks was to request them in advance of adjudicating cases.

    We believe USCIS exhausted the visa numbers by simply requesting them - not by using them. If so, and for reasons we will post shortly, we believe that over 30,000 visa numbers requested by USCIS will go unused - and will be wasted this year!

    Hi Ron,

    Tons of thanks for your time and this letter. Though most of the case are pending with Atlanta, there are few people struck with chicago as well. But the number is very small compared to atlanta. This template sounds very good to me, I will post the same at IV and let you know the feed back. Also I will direct the folks struck in chicago to you, they can hire you if they want you to represent them or I will ask them how do they want to proceed.

    If we give the case number and employer name, would there be any impact/side effect ?

    All of the Chicago cases have been transferred to Atlanta. If the Chicago guys want to talk to me, I�m happy to do so. They don�t have to hire me if all they want is information. As for putting names and case numbers, without that information, they won�t take the letter seriously. Also, I think that this will get the DOL to move on those cases. Almost every time I have made a specific complaint, they have responded by resolving the case right away in order to make the whole thing go away. It wouldn�t surprise me to see the same thing here.

    I think you are wrong. you might read his forum but I think you missed this. he did report that Oppenheim offered insight to him and other immigration lawyers about the April VB before it was published. see this message dated 02/14/08 directly from his forum:

    "Last night, at a meeting of the American Immigration Lawyer's Assocation Southern California chapter, Charles Oppenheim spoke. Mr. Oppenheim is the officer within the Visa Office tasked with calculating visa bulletin cutoff dates each month. He offered the following thoughts as to cutoff date movement in the upcoming months:

    In April, India and China EB2 will be set at 12/01/2003
    EB3 for India and China will slow down for the rest of the fiscal year"



    Last month Ron G predicted the April visa bulletin and he did have a very good logical reason for it, he did go into details about it on his forum. He was NOT told by Oppenheimer what the bulletin was going to look like.

    Ron only wrote to Oppenheimer to clarify the April Bulletin�s wording after it came out about visa number flow from EB1 to EB2 Retrogressed countries.

    I have to say Ron is pretty impressive, I learned a ton by visiting his forum, he knows a lot about the inner workings of USCIS.

    For example I was under the impression that USCIS followed strict procedures when it came to PDs and that processing dates schedules were correct all the time. Now I have a totally different opinion.

    eastindia, you are correct. GCPerm sometime back was on a "flower campaign" mode and was asking all IV members to send flowers so that USCIS will approve his/her green card ASAP. now that, it has been approved, the user has switched to a citizenship campaign mode.

    GCPerm, a piece of advice. When a person volunteers for a cause to help others, the person should never think of how the result benefits them. If you look at IV members who are advocating for clearing this green card backlogs, by volunteering for the cause, they are not looking at how it benefits them, but how they can pave a way for future applicants.

    When it comes to citizenship it is more difficult as I have personally seen people who are willing to continue with green cards for more than 20 years than taking up US Citizenship because they are more emotionally connected to their birth countries.

    Anyway, note if you are sure of the fact that you want this campaign to continue even after six years of you starting it(by then you can become a US Citizen), then you should be promoting this.

    Example, Aman Kapoor who started IV, got his green card and still fighting to clear the green card backlog mess.

    Hope you understand the point. Nobody wants a leader who won't be able to continue once their ulterior motives are attained.

    Guys let it be selfishness... but ultimately if we win, it is a win for every one... I am living in this country for more than 11 years but still with an EAD status.... We are spending most of our life time as an ALIEN. Think yourself which is better...

    I have mailed my application to Dallas Lock box on 5/10, received on 5/11. My checks are not cashed yet and no reply on status of the application.

    I always tried to keep my life not effected by GC even used AC21 to change company, but at this time i am really frustated as I am losing many opportunites which are directly related to my GC.

    I don''t feel America is an immigrant country any more we may well be make an history here as the first batch of legal immigrants returning back to our own country.

    It is naive to think that law makers does not understand our plight, they are very well aware, they just need more H1bs, temp workers program to bring in slaves to work for their benifit

    Do you realize that we are talking about USCIS here, the most inefficient department in US? If I were you, I wouldn't be so optimistic.

    This is the same department that issued visa extension to a dead terrorist after 6 months of his death.

    Right!
    My logic is, they know LOT(thousands) of PPL will be filing. I think they must have a plan. Cause I don't think they opened the gate to reject the applications. There must be a plan.

    The problem with the EB Community/ IV members is that we think that going and talking with our lawmakers is not going to help. Or, we are under the impression that all politicians generally know everything about us and are just unwilling to do anything about it for political reasons.

    The truth is that 90% of lawmakers and their staff have no clue that there are thousands backlogged and stuck in this process for a decade.

    It is our job to educate, bring our issues to light and keep pressure on them to bring/cosponsor or vote for a meaningful bill that will allievate our problems.
    .

    Precisely, members underestimate the importance of meeting lawmakers in a large scale. When we meet members of Senate and congress all over the country, not only can we get a new Bill, but our provisions could also get attached to any other Bills once they morally support us. But it will not happen if you just send chain mail, its all about building human relations with the law maker staff and make them aware of our problems. That is why family based visas and illegals, kids (DREAM) get ahead as they have the human factor apparent.
    With law makers its all about human values, empathy, compassion, etc. - like family, kids. You can forget everything about rocket science, recursion, curve fitting - it doesn't mean anything to them in terms of getting their support. It is difficult for a technical person to understand this and their point of view. It would help to get your extended family involved if you have one.
    Even today skill based immigration is not even at the forefront of population growth, as their idea about general population is a bit different and has nothing to do with IQ. that is why extra effort is needed from us.
    There has to be a continuous relation maintained with the immigration rep of the law maker.

    Hey Girijas,

    Thanks for your confidence in me, but it is all relative, I think I am a slow, average runner, slower than most of my running friends.

    When I started running 10 years ago, my goal on the indoor track was to go around the track 2 times without having to stop and walk. Those 2 rounds made up a small distance of less than a quarter of a mile! So you see, small goals can one day lead you to a 26.2 mile goal as well :)

    I think most on here know that IV's central goal is to clear the backlog
    However there are many underlying specifics to get to this goal
    and i think that's what the members on here want to hear about.
    for example
    Re-capture of unused visa numbers
    removing country specific limits
    Automatically granting visa numbers to those who have waited 5 years or more
    Increasing the total number of EB visa numbers
    Allowing non-current people to file I-485 and get EAD

    As you can see there are many different causes and many different solutions
    What is IV advocating...which cause?...which solution?

    StarSun, Pappu please don't take things personally. Not all members can go to DC or visit their state representatives. I am sure IV has many other needs. If we can identify and openly publish a list of things that are needed then we can certainly increase volunteers and participation

    Btw...how do you join the state chapter?
    The answers to many of the questions asked may be obvious for you since you are heavily involved with IV...but they are not obvious to a lot.

    I do understand not everyone can travel to DC....but whats stopping to meet your state represenatives in their local office...?

    The new fee structure is effective on July 30, 2007, and is posted at www.uscis.gov.

    Where did you see July 1 date?
