    so you don't see a difference in how a private organization and a non-profit organization operates. Well here are some:

    1. In your office, you are actually working for your boss and you are getting paid to do what they want you to do. I don't remember getting any pay check from IV. In fact, I have written several checks to IV. This doesn't mean I can post whatever I want but as long as I am following IV guidelines, I shouldn't get harassed by folks like you who think that their post is the only important post.

    2. If you don't do what you are told at work, they'll fire your a&& and you wouldn’t know how to pay your bills next month. That's why the CEO or your boss don't have to send you a one liner before they take any decision.

    As far as I know, IV is just a group of people coming together to address a problem which is shared by all members. I know that some people have worked harder than others and some people have contributed more than others but everyone has contributed one way or the other. So for you to come out and say that you are the only one doing all the work and others are just doing nothing and some how you are the CEO of this organization is just beyond my imagination. May be it's time you wake up and smell the coffee.



    In your office do you ask your CEO/VPs to first send you a one liner before he takes a decision on your project? Think about it

    I'm sorry to hear this...Its happened...
    if you really wanna bring your employer to lime light..prepare yourself..first....Remember..its your life here...anyone[including me) can give free suggestion here ....

    There is no use working with this kind of Employer anymore...so my advice is switch to another employer[Good One] before you react to this...Make sure you pretend as if you are not aware of this and get the best out of him before you leave...once you r done...then show who is he to the outside world...

    I'm sure you be having atleast mail proof...[If not ditch the plan of suing and move on with your next opportunity]....take some time and prepare all the possible proof...hire a good lawyer....File a case against the attorney in the local law chamber where the attorney is practising....they will definely call you to settle the case...make sure you record it as the proof[if you don't have one already ::)].....

    Then hit the employer...make sure you ask a collosal sum through your attorney[Never give chances]....and then post his name and details in the Immigration blogs....

    You lost one of the major milestone in your life...never give up this time....

    This is really a good advice. Yes, it is important that you make sure there is no threat to your job or H1B visa. Once you are at a safe position, then roll up your sleeves and show your power.

    What will be the basis for emergency appointment ? I was strictly warned not to mention AOS as the basis for the request as it can seriously harm.

    I just checked the Mumbai consulate website (I am assuming your wife is in India) and the earliest available appoitment for H4 is July 27th. Why cant she take that? All you have to do is reschedule.

    There are also appointments for H4 for Aug 3,6,8,10. She shoudl reschedule her appointment.

    Dude, You are looking at not getting a RFE based on the pics. Not that picture people or JCPenny takes great pics and make u look like Brad Pitt or Tom Cruise.

    I got 2 RFE's for pictures only. Those are the only 2 RFE's till date for me.
    I had real bad experience with digital pics. But there are many people who didnt have any issues. So it is all your luck.

    If you have RFE, it sets u back by 2 months for the approval.

    Just my 2 cents.....

    My experience with Picture People was ok - fair, I guess those are fine pictures as per USCIS specifications, but nothing out of the ordinary. 14.99 for a set of 4 pictures. Set me back about $80 for 3 sets of 8 pictures.

    But my own pictures came out better and are as per specifications. The question is whether to take a chance in case i missed anything or to go with Ok-Fair pictures from Picture People. decisions.. decisions... damn.. retrogression

    i agree...you bet i would accept substituted labor, heck i would even bid for one if it it was legal to do so. to each his own, i would do anything to get out of the hell hole legally...talk to your lawyer and go for it, it will save you a lots of time and headache. Make sure its all legal and the documentation is in order. there is nothing to hush up, thousands have done this and are doing it. People like me will feel bad and jump up and down, simply because we did not get that chance to do the same..good luck.

    speak to a lawyer and stop responding to people on this thread!! everyone pontificates. all the people who are screaming from their rooftops here about ethics etc., would readily accept an offer of reusing a previously unused LC if their employer gave them the option.

    a) Republican base is not you and me, in case you haven't noticed they either cater to big biz or to a specific "kind" of Americans.


    but that specific kind is now the majority, the senate seats they lost are because of the extreme views of the candidates


    b) Tea Party is basically opposed to many things including free trade and immigration. Like any other politician they might change when they have power, if they don't then hope things don't get worse.

    c) Nikki Haley and Bobby Jindal don't represent us, they are American for all practical purposes. If anything they have distanced themselves from any indian heritage in their campaigns. Nothing to expect here.


    so are thousands of desis who got GCs recently, most of desis who get GC immediately become anti-immigrant, not sure why but they start protesting h1b programs, oppose visa recapture and so on, not everyone but my personal experience is really bad,

    Regio.nal Centers . What is that mean?. Is it only for the investor who does business in Targeted areas? or employees who works in the under served areas

    but isnt this the reason for LC advertising? That is, if a USC or permanent resident applies he should be given preference over an immigrant. By that rationale I am not so sure it is illegal.
    Also, many large companies, when applying for jobs on their websites, mandatorily require you to state your visa status. While self-identification (race, sex) is always optional and cannot be required (by law, there will alwyas be a staement that says submission of this info is voluntary). t
    They cannot ask it if it is illegal, and clearly this information is used in the employment process.
    So, I am not so sure this is illegal.
    I am pretty sure that discriminating on nationality is illegal, but that is different

    Yes! An employer can chose not to sponsor a H1B and hire a USC or GC holder for various reasons (for examples companies dont hire H1b's for positions when they are laying off ). AFAIK, EEO doesnt consider a H1B applicant in the aspect you are talking. When EEO talks about National Origin, it is talking about any discrimination faced by you in case if you are denied a job given that you are Indian/Chinese/whatever.

    Initially I too got the same doubt that it could be a prank from my friend. But the name of the person who called me matches with the name of the person who visited my employer's office around 2 months back. After I got a call from ICE officer, I notified the same to my employer and explained about the call.
    Really donno what to do.... Even though the ICE officer took prior appointment for visiting me, should I still contact attorney?

    Nah Man. No FP yet. I called USCIS last week and customer service said they have sent some notice and she was not sure about the type of the notice. I will wait till this Friday and will try to contact USCIS again on Monday. Will keep you posted. Also I didn't file DHS 7001.

    Any update on your FP notices yet? am still waiting. Did any one of you file DHS 7001 for ombudsman inquiry?

    This is really sad and very unethical. As my lawyer would put it, the I-140 is owned by the employer that's why he was hesitant at first to give me a copy. So I guess, your employer can do this. I think he knows that you won't have the gut to expose him since this will also put you in an awkward situation since you paid for your labor and I-140 which, strictly speaking, is against the immigration law.

    Think of other ways to get even with him.

    I changed it to clarify. The answer is YES, we have had 100% approvals for CA=MA, but we have done relatively few. This is based on Indian documentation that CA=PGD. However the stronger evidence points to CA=BA. As you can see someone on this board got an approval for our evaluation for a CA=MA with a professor's expert letter. The professor's letters are not cheap but effective.

    In India, only UGC (University Grant Commission) is qualified to issue equivalency letters. Professor letter can be supplemental, but it can not be authentic certification, as UGC is only one to issue that.

    Thanks Pappu and IV for doing this. Maybe this should come with a big disclaimer that this is just a prediction and nobody can predict how USCIS\DOS behaves on a day to day basis, therfore dont put any weight or hopes on this projection, otherwise this will turn into the infamous prediction from VDLRAO who claimed Eb2 India will be current in a year. The year has gone by and Eb2 India is not even clearing Jan 05.
