    Congresswoman Zoe Lofgren (D-CA), chair of the House Immigration Subcommittee, sent Secretary Chertoff a list of questions and a request for documents from USCIS to get to the bottom of the whole Visa Bulletin fiasco. The letter is very interesting not just because it puts a heck of a lot of pressure on DHS right now, but also because Lofgren's folks imply from the questions that USCIS was short circuiting established security clearance procedures to "pre-request" visa numbers from DOS. If it turns out full security clearances were not carried out, USCIS will either need to say that they had the legal justification (which would be a public relations disaster for the agency) or that they intended to complete the checks after the fact (which would be a direct violation of their own regulations). The only way to avoid answering the questions and to make this go away would be to eat crow and start working the case July cases.

    Doctors are EB2 and EB1.
    They are not EB3

    Even Physical therapists are EB2.

    EB3 are low level/entry level programmers or skilled workers with with undergraduate degree or diploma degree holders that use education evaluation service to prove that their diploma is equivalent to an undergraduate degree.

    Now some of you will say you have masters degree and still are EB3. It does not matter if you have a undergraduate degree from IIT or Harvard and have MBA from Harvard. If your job needs only undergraduate degree your master degrees are useless. You are working in a wrong job and overqualified for your job. You should look for another job that needs your american masters degree. Some will say that their lawyer filed in EB3 even though they qualify for EB2. Now that is also a wrong excuse. If your lawyer and HR screwed you, it is your fault that you could not stand up to them. It is not USCIS fault.

    People (who just got current) are opening SRs and writing letters to their respective Congressmen because visa numbers get used up pretty fast.


    If this continues, pretty soon expect to see an advisory from USCIS asking people who become current to wait for at least 6 weeks or something like that. This is only making their job difficult.
    Also think twice before opening an SR, as someone earlier said his case went into some other loop, you don't want to put your hand in hornets nest unless it is absolutely necessary.

    I mailed mine on 9 th April. Just follow the check list from consulates website.
    Sent $60 Money Order. Recieved the passport along with the old one on 28th April 2009.

    My experince has been good.They promptly replied to my emails.

    i don't get it you are saying that members don't have to search...and yet someone has to keep it up on the home page...which is it? yes a sticky thread would have saved work and not required someone to keep it up. Why wasn't it done in the first place. When a service is supposed to be offered every week...it should be offered every week...or else there should be an announcement that is will not be offered this particular week and that it will continue next on said week.

    1. Threads cannot be a sticky on the home page. However, threads can be made sticky in the forums page under the sub-forums. The sticky thread on the Ask the Lawyer forum. (The http://immigrationvoice.org/forum/forum68-free-lawyer-conference-calls/1900583-free-attorney-conference-calls.html)
    2. The aim is to have conference calls with Lawyers for free every week. We have gotten 4 lawyers to do it for 2 consecutive days - consistently. I need one more lawyer for the fourth week - here is a task for any member who is interested. Find me a lawyer who is willing to give 1 whole hour worth of advice to our members for free, preferably on a Thursday (to maintain the same day in a week) consistently year round.

    No reason to be frustrated when people are asking simple questions...another idea would be to put the answers to the most frequently asked questions on the FAQ page...which does not work right now....so that you don't have to repeat the answers.
    Its an easy solution i think.

    Any member who is willing to spend a few hours on a regular basis, please help us with a FAQ about the site. Some of the answers are already in the forums, you just have to put them under one umbrella. Please let me know who wants to work on this project - individual or group effort.

    Giving a long lecture of frustration is not the best way to attract people to an organisation.
    Think about it...do u go buy clothes from a store that voices their frustrations about the prices of raw material...of do u go buy it because they were nice to you...had great customer service...nice selection of goods...and fair prices.

    I am sorry but working for hours on end alone, voicing frustration at lack of participation, treating members like they are morons for not being able to find supposedly simple things is a really terrible way to attract more people to an organisation. The cause may be noble...but who will wanna join some organisation where people just complain about how miserable things are.

    Please pause for a moment and think about what i am saying. This is exactly why you have less participation and less donation. IV needs to transform into a vibrant fun place to be while still upholding the noble cause.


    Let me be clear, the only way IV knows of treating its members is with RESPECT. If it was not with respect or the understanding of the struggles each of you go through - our motivation to continue this cause would have long disappeared.

    If there is frustration on our part, it exists within us, we hope for better, but the frustration (or anything else) has never stopped us from providing the service or executing the tasks.

    The "frustration lecture" as you call it was not meant to be a lecture - which goes to show that it is very difficult to control the tone and message on forums. Many people have questions, and since the topic came up, I shared some of my thoughts - to give members a peek of how things look from the inside.

    Not all our volunteering members are from DC area, they are as widely spread out as California, Minnasota, Florida, Texas, Mississippi, Tri State Area -- you name it, we have dedicated volunteers. Distance need not stop anyone from volunteering.

    I am not sure how much "hope" is selling for these days, let me know :) - Trying to make this a fun and entertaining forum :p

    Today is March 27, 2011. And I have 2 Tasks for interested members.

    1. Find a fourth lawyer to give advice for free for an entire hour - preferably on a Thursday.
    2. Help in compiling a FAQ, that will assist any new member to find his/her way through the forums.

    Thanks for the offer, but this is just a preliminary meeting for me to meet some of the people I have worked with over the past year via phone and email. However, since these people have some influence, I also wanted to discuss with them some of the more important issues facing skilled immigrants. I will mention the idea of meeting with more people in the future. I think it is important for them to be more in touch with those who are affected by immigration policies. My sense is that many of them don't understand the issues very well.

    I don't have clear picture on what IV is planning to do now except that FOIA drive. I request the core team to inform all IV members explicitly about their plan. I guess there will be more donations than they expect.

    suggestion: while sending emails that there is a reply to your post, they should also add the actions they have been/ or planning to take.

    Years we have been told priority date establishes your place in the queue.

    We have spurned job offers and declined the new PERM process to hold on to the priority dates.

    Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.

    People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.

    Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

    Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

    Here is a AILA memo to USCIS addressing this issue and making clear that it is illegal to not accept applications when the bulletin shows the dates as being current

    So basically USCIS is in violation of regulation for not accepting 485 petitions for EB3-other worker category even though those petitions are current as per June Bulletin issued in May.

    I hope USCIS atleast follows the regulations and laws. Coz we just finished with an 18 month debate in the Senate today on law-abiding done by immigrants. And now suddenly USCIS is acting like an undocumented worker ignoring the laws and regulations.

    You can take these at any Hospitals or Clinic. They are quiet costly but my insurance covered them 100%.

    From my understanding you need all these completed to be able to file I485, when ever that may be.......

    Hmmm... humorous stories...

    Well there was gsc999 and jazz trying to pull a "room service" gag on Drona and myself, but they went to the wrong room...

    ... I've heard some pretty hilarious tales about a comedic cab journey with a driver that wouldn't obey, and got some impromptu driving instruction by Logiclife...

    ... but a lot of the others must stay in DC :)

    Most people are not willing to share the knowledge they learnt.

    So i would request you not to get carried away by few folks who are asking stupid questions like post your transactions or tell us how much u made etc...
    What do they expect you to post your SSN and W2 or what :D

    Couldn't resist. Please follow the FOIA thread that is in red.
    10,000 was collected and 2500$ advance was sent out to USCIS. Now we wait to hear back from them.

    Do you honestly think something will come? I doubt. They asked for $10K as a routine without investigating into what is possible. While quoting the cost, they even asked "What is a Priority Date".

    PD's are not anywhere in the system. They are nowhere other than filled in ink on I-140, or I-485 applications or receipts. Even there, sometimes they are blank or wrong. They check manually on these dates while approving applications. That's the whole reason that all cutoff date movement is based on pure guess work, and approvals are never in order of PDs.

    Do you think they will check each application manually, and count them based on PD's?
