Why do you think I should go for a new H1? I can always call my wife on a visitor visa. She can stay on a visitor visa in US for 1 year continuously. So why bother for an H4?

She may not get a visitor's visa. Visitor's visa requires non-immigration intent, just like F-1. In your case, there is a very clear intent to immigrate, which may disqualify her from getting a visitor's visa.

That will be a big issue. You do have to show that I-485 has been pending for 180 days before you changed jobs.

that was a very interesting read. Another scary part is that it took USCIS 6 months to revoke teh I-140 from the time it was requested. Meaning when he actually left his employer, if he had called up USCIS to verify the status of his I-140, it would have come up as still-valid.

Thanks to every person who answered this post. I managed to get an appointment in mumbai for Aug 2nd. This will give enough time to send necessary document from my end and also give enough breathing to file the application.

If you look carefully health insurance payments are deducted in advance from the paycheck. So if say you join the new company in February the old company's paycheck at the end of January should be deducting health insurance for February. Therefore if the new company provides health insurance from March you should still be covered without requiring COBRA.

Second, and more importantly, with control of the government now divided between the two parties, it will no longer be easy for the Republicans to blame the Democrats for the state of the economy. Nor will it be possible for the Republicans to simply say no to everything that is proposed in Washington. That strategy was useful when the Republicans were completely out of power, but the context has now changed.
This may lead to better bipartisan cooperation in Washington, but that is unlikely, particularly given the a real possibility that economic recovery will not happen by 2012, not because of the failure of politicians in Washington to address the problem, but because of the depth and seriousness of the problem itself. Lawsuite may not work in all occasions. If visa's are not available how can USCIS approve a petition? The law say a VISA should be available in order to approve a GC.

This is really sad and very unethical. As my lawyer would put it, the I-140 is owned by the employer that's why he was hesitant at first to give me a copy. So I guess, your employer can do this. I think he knows that you won't have the gut to expose him since this will also put you in an awkward situation since you paid for your labor and I-140 which, strictly speaking, is against the immigration law.
Think of other ways to get even with him.

Today I got a call from an officer in "immigration and customs enforcement" asking for an appointment to visit my residence for checing my immigration status.
I am on H1B visa.
I would appreciate if someone could give any sort of information related to calling for a home visit.

Immigration office can come to your home to check on you if your application is family based, like spouse living together or not. But since you are on H1B, I don't know why would they come to your home. They should check with ur employer and do the verification.

I dont know what to do. I opened an SR on Oct 8,2007. My ND is Sept 10. And so far no FP appointment yet. My app is at TSC.

Nothing yet...I was out of town for a week and just got back home last night...writing to ombudsman did not help either. Will just wait!

Yes you are right, there is bound to have EAD flood in market, with spouses of hi-tech worker will come to market to search hi-tech job with spouse phone support. I have seen such cases countless times in past few years and yes they will be in future without exception. However, matter of fact, these fresh EAD (previous H4) don't get the dream job in first attempt, it takes good 2 year to find a similar job that H1b hitech worker does.
But thats the realty of market, every year new jobs are added and every year new job seekers join the crowd.
On the otherside, a hitech worker is suppose to always learning something new and getting his/her position more stronger everyday, its a knowledge market, whoever knows more gets better $$. With my 7yr US exp and total 10 yrs CS exp I have no scare that any single fresh EAD will come close to me. A senior is always a senior no matter which field you talk.

Has anyone thought of the people who missed the august 17 deadline because the labor was not cleared within time. Because of no mistake from ourside, we have to suffer. What a screwed up legal situation ?
As of now PD is apr 2001, I dont know when will it move ?

The one consolation is that once you get to file your 485, you should not spend too much time in that pending 485 situation.
So if you ask me today, would I rather have filed 485 with a PD of 2006/7 or be in your situation, as bleak as your situation looks today, the better choice might be your situation.

I'm on HB1 but my visa which was issued based on previous H1B has expired. My current HB1 is going to be extended in a few months. I kept postponing my travel to India because of the hassle involved in re-validating visa. I will have to use time off my vacation to get the visa stamp. I did not travel for almost three years. Now, I must travel in November and have no option but to go through the cumbersome process of visa revalidation. It would be such a blessing if I could get the stamping done here.

Since EB2-India is current, I am exploring the possibility of interfiling.
Goal: Interfile in such a way that my new application under EB2 (New case
category) get attached with old case (EB3) priority date (07/2003) and
thus enable me to take advantage of EB2 current PD as declared in
April 2008 bulletin.

Update: My lawyer just got back to me on this. Since I wanted the interfiling in such a way that I can maintain old PD ( July 2003 based - EB3 filing - 485 filed under this) with new application category EB2 (new application - June 2006 PD), lawyer told me that it is not possible. Once I interfile my new application, end effect will be having my 485 based on EB2- with new priority date (June 2006). So at this moment I have 2 choices...
1) Wait out till July 2003 under EB3-India become current
2) If EB3-India is not moving at all or July 2003 does not become current for EB3 but meanwhile if EB2-India cutoff date crosses June 2006 then file interfiling.
