    - Labor was filed with a minimum requirement as Masters degree. No alternate degree requirement or equivalency was mentioned. --> just found out that it did say BS+ 5 exp is ok - USCIS mistakenly approved the I-140 (I am assuming OP does not have a US Masters and only has masters equivalent or BS + 5 yrs)
    - Sponsoring employer revoked approved I-140
    - USCIS checked the I-140 and realized it made a mistake in initial I-140 approval
    - USCIS denied the pending I-485 based on incorrect I-140 approval

    If all of the above is correct, then I doubt if anything can be done. I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

    Since the application do say BS+5 years and I have copy of the Edu evaluation which says Master equivalent , I do see a good chance now to re-open the case .

    Mine is not a labor substitute. ( just to clarify)

    Thanks for the info. I went and pulled up the 9089 filing and just saw that the filing date was 15th may 2006, the expiry date was 3/31/2008 and hence i might have incorrectly assumed that the filing date was 2 years before that.

    Sucks! i missed the cutoff by a week

    I have to respectfully disagree with the point 4 you have mentioned.

    If a thug is attacking you, it is best to just obey what ever he is demanding. Under no circumstances, try to outsmart him. Us trying to outsmart a thug during a robbery will be like the thug trying to outsmart us in computer programming.

    If a thug wants the car, just give him the keys and walk away. Insurance will pay us the price of the car - deductible. The same amount we will get, if we take our chance and destroy the car trying to outsmart the guy. And who knows, may be the 'thug' is a cousin of yours trying a prank on you. And in the dark, you could not really see his face.

    Robbers charging your credit card is no big deal either. There are federal laws protecting us on incorrect credit card charges. Would you want to risk your life for just $50?

    Folks, please be extra cautious when you get into in your car.

    1) Always check the rear seat before getting in your car. A crook might be hiding there.

    2) When you get inside a car that is parked in a building ( with insufficient lighting or no people around), immediately lock the door. Thats the first thing you have to do, and then arrange the shopping bag or item that are in your hand.

    3) If some stranger is approaching you, be cautious, no matter how 'friendly' he looks. Think fast and look for exit signs and plan an exit run, should the need arise.

    4) I read long time ago, if in the worst case, say a carjacker who gained access inside your car and hiding in the back seat. And if you have not noticed anything and you just started the vehicle and are about to go, he puts a knife of gun and asks directs you to drive his way, then, JUST SPEED UP STRAIGHT AND HIT THE WALL OR PILAR AS FAST AS YOU CAN. The air bag would protect you after the collision, but the passenger(carjacker) would be thrown out or would have sever body injuries. You would have enough time to escape with minor injuries.

    5) Take precautions and don't loiter in areas that you not familiar with.

    Hey Guys,

    When applying for CP the consulate we can apply to...does it have to be only the one in your home country (American Embassy in Chennai) or can it be the one in the country of last residence.

    I have studied and lived in Canada for 3 years before coming to US. I am wondering if i can choose American Embassy in Montreal as my consulate post (country of last residence) or is my option just the consulate post in country of birth

    Any thoughts on this greatly appreciated!!!

    This is called waste of brain power ... cramming as much as you can from the dictionary and god knows what. It would have been much better if a child learns some skill or diverts the mind towards exploring a problem or invention . What use is cramming the dictionary when it is available right on your phone now . If you have the internet all the world's knowledge is searchable.

    There are much better uses for the brain power.

    I've the same question. It sounds pretty stupid that Indian government allows you to have Indian passport if you register the child within one year. Looks like the child has no say in the process. Also, once the child gets Indian passport, can she revert back to US citizenship and hold US passport by renouncing Indian passport? Or do she need to wait 18 years? Once the child holds Indian passport, then does she need to get US visa stamp to enter US? Also, can the child hold both US and Indian passport?


    well said my friend and i agree with you completely. although, i grappled with this issue when we had a baby.......the question where i got stumped was - if i got Indian Citizenship for my child (born in US), what would be the child's legal status here? and, also if we were traveling outside the country - how would the child reenter US?

    I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.

    I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

    I am sorry if you have answered this question before. Did you made a phone call to USCIS and tried to get update on your case from IO instead of relying on your Attorney ?

    My humble disagreement here...

    Even though the hearing has been scheduled for the bill S 424, the hearings are not tightly linked to a specific bill. Hearings are a means to collect the data related to the issue at hand. The hearing results can be used to a wide range of related bills. S 1085 is a very similar bill and the emphasis of this bill is also reuniting families. During markup of whichever bill they pickup, they can amend the new pieces of the other bill.

    If it is a markup, then, it is tightly linked to the bill.

    So, definitely the party remains in good standing :)

    Sorry to spoil the party guys..but it seems this hearing is for
    S 424 - Uniting American Families Act of 2009

    Dear All,

    Let us strive to achieve 10,000.00 contributions this month too. I request every one to please understand that either we get our GC's this year or forget for another two years due to mid term elections next year.

    If we can pool really good amount, we may at least be able to lobby USCIS for some relief though with these small contributions, we may NEVER be able to lobby the congress.

    We do not need to tell IV core what we want, they are all aware of our goals. But small contributions like 50-100 may not be enough to lobby to convince Congress our great contributions.

    I am EB3 Oct 2002. Just received letter from SSN that, I have 40 credits now. We still can not even estimate when we will get GC's. In few months or few years?

    If we think of 200 or 300 dollars, we may have to continue to suffer like this.

    Can we determine to pool in at least 200,000.00 (each to contribute at least 300 dollars) so that we can at least hope for GC in few months and not years.

    Please help yourself.

    Why the bloody hell are you guys judging him for what he has done? He only asked for some advise regarding immigration implications of his situation.

    I do not think any of you who is beating him down like this has any right in doing so. I bet that each and every one of you have done more mistakes than Mr.Sahaayam did. You just were never caught. You must have done more filthy things than 'shop lifting'. I'm sure you have all lusted after women, watched porn, frequented strip clubs and drank a lot of filth. Some of you might have slept with more than one woman.

    Don't you think these are more filthy than shoplifting? Guys come on! I would not have any problem if one of you who has never committed any mistakes in life would point out other people's mistakes. But none of you are good enough.

    If anyone wants to reply to my post, I would like the first person to do so to be the one who has never committed any mistakes in life so far! Others please get lost.

Based on USCIS use of visa numbers as of May 2007, at present consumption rates approximately 40,000 visas will be lost in FY 07 without a dramatic increase in USCIS requests of visa numbers. As illustrated below, since 1994 there have been over 218,000 un-recaptured employment-based visas lost due to underutilization of the employment-based visas."

    no lawmaker is bothering to read this silly thread. Please stop dreaming. if you want to influence, go meet them! that remain's iv's official word on the matter too...see the meet the lawmaker campaign. and if you already have...you have my respect, you are too good in that case to waste your time complaining about this stuff.

    The real problem has been the l1 visa..and ignorant americans do not know the difference and they think everything is h1b but it is the L1 which has caused wages to drop....

    Infact theres no limit on L1 quota like H1B.

    See really ..my ignorence on this option ( of making smaller contribution using paypal- donations@immigrationvoice.org )... is probably why some of the guys I have spoken to at work have also not contributed yet..though they all visit and adhore the IV effort..

    But here is the one that turns me off everytime I visit the contribute section of the IV site.. (" Note : If you previously signed up for $20 per month recurring contributions, you don't have to do anything, they will continue as $20 per month until you choose to cancel them. Beginning 5/17/2007, we only have 2 options for recurring payments : $50 per month and $100 per month.
