    EB2 cannot combine education or work experience. It must show a single source degree.

    Note the following information from the 2006 annual conference of the American Immigration Lawyers Association (AILA) in San Antonio, Texas. "For employment-based immigrant visa purposes (aka green card), the U.S. Citizenship and Immigration Services (USCIS) will not equate a three-year diploma plus a post-baccalaureate diploma as being the equivalent of a U.S. Bachelor's Degree for either EB-2 or EB-3 classification. Additionally, the USCIS does not accept a combination of academic background and work experience as being the equivalent of a U.S. Bachelor's Degree for "green card" purposes"

    This can be done for EB3 IF it was stated on the labor certificate.

    Education evaluation was not done for bachelors because the Labor only required masters. My attorney is planning to use 2 years of my experience to compensate for the additional 1 year of bachelors degree

    Even my attorney says the argument of USCIS could be "building blocks" argument i.e. In US, for masters, 4 year bachelors is required. But, I only have a 3 year bachelor degree.

    u can easily get an affadavit from someone with a business that says u worked there for a period of x days while ur h1 was with yyy company... that puts u into an illegal category too.

    i m growing some tomatoes this summer....maybe i can get additional points if i grow them for 100 days every year and then after another 5 yrs i can get some more points in the new merit based system


    Well they will easily find out from your SSN number if one is on payroll or not. I am seriously looking into this matter of getting illegal and many of my friends agree. Once the bill passes in its current form we should get advise from a good lawyer to convert status from legal to illegal. It sounds so insane when I say changing for legal to illegal..but that is the hit thing these days.

    You may admire them as much as you want but fact is these are just "glorified" bodyshoppers. I meet many workers from these "great" companies at my workplace and see them being treated just as "low cost alternatives" and nothing else by this huge financial company in NY/NJ area. Because of their (INFY, TATA, Wipro, Satyam) "low billing rates" these guys cant afford good lifestyle. And back home in India INFY and TATA CEOs make billions and talk BIG. I've not met any TATA, Satyam guy here who is happy with their employer. They just hate their employers and always looking for a change. I wonder where they stand in terms of employee satisfaction? They treat their people like slave and send them as low cost labor. Not only that - they exploit US immigration rules and make use of L1 to keep their people long term at cliant place when they dont get enough H1.

    No difference from local bodyshoppers! Dont think they are great companies. You may say "you folks are frustrated with these companies". But this is the fact. Period.

    I think this thread is hijacked. I will also join the band :p I work for one of these companies (SWITCH - Satyam, Wipro, Infosys, Tata, Cognizant, HCL) and came on L1, became H1B and on the path of GC through the same company. Some of what you have said is correct that the employers are not paid same as what IBM US employers get (and of course what some consultants get). Some of the issues are working off-late hours and coordination effort etc.

    The positive side of these companies is
    1) Career advancement - One can really grow into lead and managerial positions if they have the aptitude
    2) Technical Career Paths are there for those who are technically inclined.
    3) Benefits - There are good benefits which usually may not be there for those working for desi-consultants
    4) Support from a large pool of knowledge - If I face any issue, I post it in my company help forum, there will be many responses,some real good ones within a day.
    5) More job security - companies are not yet used to down-sizing. In hard times, there could be some salary rationalization (which I think is OK - better than losing job) and increased utilization (again doesn't mean more work from individual it means optimal bench strength)
    6) Growth - While it is debatable whether it can sustain the rupee strengthening or not, unless the company 's strategy is very narrow, nobody outsource for the cost alone...Many are simply build-or-buy decisions, and based on core-competency and risk management. Deals that are struck these days are multi-year, multi-million dollar ones which will provide guaranteed business over a long periods.

    Coming to those who come on L1 or H1, most of them want to get an opportunity to work at client location to better their perspective (apart from Dollar conversion). Nobody comes here by force. Their priorities are always different than most of the forum readers' Their choices are also limited. Some leave as soon as they come here (I personally interviewed at least 10 folks last year who floated their resumes as soon as they landed here), some want to go back after working here few years, some switch to H1Bs through desi-consultants, thus enter rat race, some try to grow here in their company on long term basis.

    Hope this clarifies few who pity SWITCH employees..

    Again these are not "glorified" bodyshoppers. It is a very wrong impression. I am a manager at one of such companies. We have highest regards for our personnel, we strive hard to make a big difference, we compete with other service companies like Accenture, IBM and EDS, have high client focus and we feel proud about it. Never in ANY meetings or strategies we keep our employers' interest below anything.

    This is not to oppose your message - I am just trying to figure out where these arguments comes from because I don't think I believe in this whole fraud thing. AC21 is meant for one to change jobs after working for the original sponsoring company for 180 days. Also, there are no clear guidelines stating that one must inform the USCIS - so what will this fraud be based on? How can one be committing fraud if there are no guidelines to tell you what is considered fraudulent? I think one is fraudulant when one actually violates some set rules etc. I don't think the USCIS can have a basis for suspecting someone of fraud when they don't even have a definition of what may constitute fraud in this case because of the lack of guidelines. Plus, I have never, ever heard of anyone be denied or suspected of anything like this during citizenship, I just don't believe this is a factor AT ALL. I see these comments a lot and they just don't make any sense to me. To me, it is like breaking a law that doesn't exist. And you say one may be "suspected", well, suspicion is just that, suspicion. The USCIS needs to show proof that you intended to be fraudulent and for as long as there are no AC21 guidelines that tell you that you must inform the USCIS upon invoking AC21, the USCIS will not and cannot have a case against you.

    I agree with you. It's not required by law to file any AC21 papers so the USCIS cannot do much. Also, the green card cannot be revoked after 5 years so by the time you apply for citizenship, the USCIS cannot do anything bad to you. Worst case, they will ask about it during the citizenship interview so it's a good idea to keep your employment offer handy. But it's very unlikely and I really doubt they can deny your citizenship based on this. That's why I see no drawbacks in not filing AC21 and no benefits in filing it if you know that I-140 won't be withdrawn. My advice would be to take an employment letter from current employer and keep it in case the USCIS asks for it. There is no need to cause troubles for yourself by letting the USCIS know about it.

    My spouse is landing here on Aug 15. That leaves only one day to get medicals done. Any suggestions on how to handle this ? Can she skip skin test and take X-rays directly ?

    If you talk to your medical office in advance to see that if they can give report in one day then it could be possible. Also you may consider your wife to get all vaccination in advance from the place where she is staying currently. Can't she prepone her trip by 1-2 days?

    IV has the clout now to approach agencies, explain to them our argument and see if we are able to convince them for short-term reliefs. It is just a matter of trying.

    I'm smiling. We will certainly try, but the part above (clout etc) would be an overstatement of our current levels of access. :)

    Note that these are the same agencies that have been resisting our efforts to get even the most basic breakdown of data.

    I am in a similar situation and have a very simple question. Can I port from EB3 to EB2, while on EAD? I do not have a valid H1. AFAIK porting needs re-filing a labor application, hence the confusion.

    Well my friend, don't bring your pretentious "I'm-so-great-I'm-non-judgemental-oo-la-la" BS here. If we don't make it clear in our replies that we do not condone any actions that break the law, we are just making it easier for anti-immigration people to easily point fingers at us and claim we are all drug peddlers or criminal.

    I would urge more members here to reply to the OP that we at IV do not have any sympathy for people breaking the law.

    As for you, think before you type!

    With your history of getting rammed here i would avoid saying that if i was you,

    I agree with making it clear that we ( the forum members) condone actions breaking the law but there is a difference between telling the same to a person in a professional manner as against shoving our personal moralistic BS in their face.

    I read somewhere that doctors abroad who do the tests for consular processing cannot be used for AOS medicals.

    u'll get RFE only if theres is a mistake in medicals, if there is NO medicals in the 485 packet, i think ur appln will be outright sent back.

    whats ur PD, if its in the range of 2000 u still have hope that in next few months ur date becoems eligible for AOS.

    ive heard that there are some doctors out there (of questionable integrity) who accept cash and give out medical reports. even tho this is a backdoor approach, u can make a few calls and give it a try. to make ur case more genuine, try to get a list of all attributes recorded in the blood and skin test, and get those done promptly done in india. atleast let the doctor copy over ur wifes actual stats rather than inventing it. If ur case is genuine, may be someone will be merciful to help u out of ur predicament.

    Preponing visa interview without very valid reason cud be harmful. u never know, if they catch ur wife telling a lie then ull be walking on thin ice.

    last year my friend visited india...he is on 7the year H1, and got 3 yrs extn based on 140. he had attached copy of approved 140 as proof...the chennai visa officer only asked him "is ur company paying for ur GC or you urself" ..he answered Company is paying full amount. and they gave him the visa. :-) if Govt is using approved 140 to give 3 yrs extn, obviously they know the intent to get GC...i dont believe telling truth that ur company is processing GC for you is going to harm you.

    its just my opinion!!!

    Yes you are right, there is bound to have EAD flood in market, with spouses of hi-tech worker will come to market to search hi-tech job with spouse phone support. I have seen such cases countless times in past few years and yes they will be in future without exception. However, matter of fact, these fresh EAD (previous H4) don't get the dream job in first attempt, it takes good 2 year to find a similar job that H1b hitech worker does.
    But thats the realty of market, every year new jobs are added and every year new job seekers join the crowd.
    On the otherside, a hitech worker is suppose to always learning something new and getting his/her position more stronger everyday, its a knowledge market, whoever knows more gets better $$. With my 7yr US exp and total 10 yrs CS exp I have no scare that any single fresh EAD will come close to me. A senior is always a senior no matter which field you talk.

To live with it every day makes it harder. The only thing to not send me back is, what if someday I have to start over all this again if it makes me regret someday, I should just waited a little more to get though this process:)

    Feel good, but dont give up! Keep talking to people, send emails, letters to senators and congressman, support IV on their initiatives in how muchever you can, if you can is the tone we should set in this forum!

    It was good to see and meet you at the rally .I was wondering if IV or its leadership have any updates on, when any bill ( if any) will be unveiled in the house . The end of the year is fast approaching and although we hear every other day that Nancy Pelosi or Zoe Loefgren is going to unveil something , nothing seems to happen . Only letters are flying back and forth each day from Governers and Tech industry representatives , but there seems to be no action . I prefectly agree with the fact that people are getting a bit overly impatient on the issues here , but I who has been patiently waiting and waiting and working with the state chapters just see a lull and silence on the immigration front ( Skilled and Unskilled ) . No one wants to talk about it or do anything about it on the Hill.Please prove me wrong here , I WANT TO BE WRONG !!!

    Also, you are forgetting about 7% country quota and the demand from ROW (which itself is retrogressed!).

    So no matter what you may think, without IV it's going to be a long wait


    The other bottleneck is USCIS' inefficiency, not a lack of visa numbers.

    If you go thru the statistics of last few years, the annual quota for EB is 140,000 + 80,000 from family other category.IV might want to convince us otherwise, but looking at the numbers, I do not see a shortage of visa numbers.
